need serious answer to Serious question,..

Default need serious answer to Serious question,..

I am NOT upset about the immigration process,.. My Wife will be here before
the end of the month,..
HOWEVER,.. in this K3 process, the consular has asked for documents that
were not required,.. in fact,. it states clearly the documents are not
required,..
I have done my homework,.. read the I-129 instructions for K3,.. checked INA
chapter3,.sections 221 specifically,..
there is no question the consulate was incorrect,..
specifically,..divorce documents are not required for k-3,..
I have silently complied with the request,.. no problem,..
My question,..
After my wife is here,.. is there any way to report this consulate for
overstepping his legal boundaries,..?
many consulates seem to be making their own rules,.. not following written
procedures,..
(same in Riyadh before 9/11,..?)
My problem was small,.. and not a big delay,.. simply want to answer to this
unlimited power they seem to enjoy,..
is there a way,..?

Go with the flow you will not win anyway and it was a minor inconvience. The consulate operates under the DOS a separate agency anyway. Save youe energy for other battles such as DMV AOS EAD..etc...

I could be wrong since it's been awhile since I've looked at the instructions on the I-129f. However, I was under the impression that you had to include w/the I-129f proof that all previous marriages were ended (either in death, annullment, divorce). So I thought that info would have already been requested, which if it wasn't, could be why the overseas Consulate requested a copy of it.

I really wouldn't pursue this line of thought either..I'd save energy and money for the upcoming AOS process and other fees as needed.

Haven't we been through this before?

The I-129f instructions apply to the I-129f petition, which is processed by the USCIS and is over and done before a case reaches a consulate. The I-129f instructions have no bearing on a consular offical's processing of a K3 visa application.

Consular officers have full authority to ask for whatever documentation they need to satisfy themselves that a visa applicant meets all of the requirements for the visa.

the old instructions for FIANCE require divorce documents since you must
prove you can marry in the future,..the K-1 is CONDITIONAL on this,..,.. the
NEW instructions for K-3 specifically state MARRIAGE certificate,.. it is
conditional on that,..must be presently married,..
I am not looking for a battle with them,..
I simply wish to report this issue,.. to whoever will listen,..
if they need divorce documents for K3,.. then say it in the instructions,..
SIMPLE,..
these people take too much time,.. and are paid too well to be SOOOOO
incredibly stupid,..
(or am I the stupid one,..?)
a side note,.. this is the USA Embassy,.. in Romania, True,.. BUT they were
VERY disrespectful to my wife,..
Why,..?
She is ethnic Hungarian in Romania,.. the consulate was Romanian,.. or
Romanian ethnicity,..
I could go into details of this meeting,. but I will refrain,..
but this is why I will report this,.. somewhere,...
does anyone have an address,.. an email,.. something concrete,..?
don't require personal advice/opinions,... thanx,..
another interview is scheduled for this Monday,.. it should be OK,.. divorce
documents are in her hands,..
unless,..... they invent something else,..?

read INA chapter 3,..
and get back to me,..?
the consulate can not request ANYTHING,..
if that were true,... there would be sexual favors,.. scandals,.. bribes,..
it is ALL written,..
section 221,.. INA,.. chapter 3,..
again,..this does not answer my question as to WHERE to report a
grievance,..

Oh,.. I was in the military,.. have a college education,.. my 1st wife was
from overseas,..I had a fiance after that, but canceled it as the wait was
too long after 9/11,.. this is my 2nd wife from overseas,..
my best friend is Russian,.. I am helping him with his citizenship,..
getting his wife here,.. I have many international friends,.. and if they
have an issue with uscis, they all look to me as a lawyer,..
(no,.I am not a lawyer,..but I did stay at a holiday inn express last
week,..)
many things/questions I see here are simply a matter of paying close
attention to detail,..(as my stupid mistake in replying to jeff so
quickly,.and incorrectly)
I am not ANGRY with the consulate,.. it is a new procedure with an old
document,.. many people here are obviously unaware of the new
instructions,.. he is only one more person unaware,..
I am simply looking for the proper way to file a formal grievance,..
AFTER my wife arrives,..
