It depends whether you have that intent at the POE, as we keep saying. The fact that you keep bringing it up makes me think you DO have that intent. If you plan to do this, make sure your fiancee is OK living in the UK forever.

there is no intent to get married right now, we just aren't there yet. we want to do everything by the book so as not to cause any damage.

In that case, whenever you feel ready to marry, choose one of the two legal marriage based visa paths. Don't choose AOS from VWP.

It really sounds like you're looking for approval to get married on the VWP and adjust status, you're not going to find that approval here.

The most straight-forward and risk-free way to be together is for her to either file an I129F (which she can do now, assuming you've met in person at least once) or get married and file for a CR1 visa. There's a handy comparison wiki at the top of the forum.

If *after* arriving you decide you want to get married, there is nothing wrong with filing an application to adjust status. It is a totally legal and valid path to a Greencard based on marriage to a U.S. Citizen.

Many people on this forum parrot information that is not accurate. If you do get married consult and immigration lawyer before you leave.

And there is no proof for that "sudden" decision, so you are left hoping that the officer assigned to your case believes you, because if they don’t, which despite Jermi's assertions to the contrary, is entirely possible, you face removal proceedings and a ban from returning.

Wrong. I suggest you checks your facts, parroting misinformation is not helpful. I also suggest you read my last post again.
