Default More Evidence

Hi:
I just checked my case number i-129F and they requested evidence. It was mailed yesterday and I'm going to recieve probably the letter next week.

When I mailed the envelope I put in pictures of us together, planeticket-stubs and letters and phone cards. Now I'm a bit worried cause I do not know what they might have requested.

Can anyone tell me what kind of evidence they are requesting or maybe give me some hints on that?

I know when I receive the letter I will know, but knowing something now will be good.
I filed for her at TSC.

Hi there- sorry to hear about your RFE, however it's not the end of the world. There could be several reasons for the RFE - do a search on here for RFE and you will find a number of different reasons other people have gotten it. It could be they want actual proof that you met, it could be the NA vs. None issue, it could be just about anything. The best thing to do is just relax and wait for it to come in the mail. If you have what they need, mail it back to them right away and you won't be set back too much. We got an RFE too through Texas (for my original Divorce Decree). I mailed it to them the next day and we were approved soon after.

I think you have enough evidence. In my interview,
we showed pictures from engagement and wedding,
especially group pictures with a lot of friends and
family members. We also showed postcard I sent to
my wife when we were still dating...and it surprised
me before the interview when my wife pull out a box
that contains everything I have sent to her

My experience was similar to Angela's -- a page was missing from the copy of my
divorce decree. I overnighted it the same day I got the written RFE (like you,
I spent a week wondering what it could be for!), and it only set us back about
2 or 3 weeks.... which I'd happily have done without, but which isn't all THAT
much.

For the evidence I supplied, it was pretty much everything that you sent. I
also copied my passport book and hers showing the (visitor visa) stamps that we
have both visited eachother's country. For pictures, I just submitted a dozen
or so of us together. The pictures I sent had a date stamp on them showing
that we have met personally withing the last few years.

I doubt they'll give you anymore trouble with the evidence that you sent in
now.

Right now i've done a little bit of research. I found out maybe I could have made a mistake filling out a form.
I´ve never been married before and the most popoluar RFE are N/A instead of None on the forms.


Now I have to calm down. I know I'm almost there.


Anyway RFE does make me nervous.

WE SENT PHOTO COPIES OF ALL THESE WITH COVERING LETTER AND EVERYTHING WENT WELL:


1. I-129F - completed form
2. G-325A - Petitioner
3. G-325A - Beneficiary
4. Legal Capacity to marry or Divorce decrees or Death certificate
whichever applies to both - Petitioner and beneficiary
5. Birth Certificate - Petitioner/Beneficiary
6. Passport - Petitioner/Beneficiary
7. 3/4 side view picture right ear showing - petitioner/beneficiary
8 Airline tickets - petitioner
9. Pictures - proof of relationship
10. Application fee $110.00

That is one of the important document all previous marriages should be legally terminated and you must send together with all other documents. Since, you are being sent a letter for more evidence , send the documents together with a copy of the notice they sent you. Goodluck!

I have never been married., do you think anyway they requested it?

I'm sorry i'm just guessing here, I will know the exact answer in a couple of days. But I hope you understand. This is a long process and lots of paperwork and I think we are always afraid of not being able to be together with the person we love.

Where I'm at right now is where at night I think it over and over what I did wrong.
I just need to talk to people who have been thru this, it makes me feel much better.

I hope it it nothing I cannot solve myself, I have done everything thanks to this forum.

Where would I be without this forum?

Anyway, back to where I was

Can you answer that about I am single , never been married. Do you think they might have requested it?

Lemon,

There is not much we can tell you at this point. There is no way of knowing just what it is that they want. It could be as simple as the N/A vs None issue, or it could be they've 'misplaced' a doc that you sent them. Who knows? Howeve, if you are single, and never been married there is no legal documentation you can get to prove otherwise.

However, this is what most of us here have done from what I can tell. When you wrote and signed the 'Letter of Intent' you could have written in there that you "are legally free to marry and will marry [name] upon his/her entrance into the US with a K1 visa." If this is what they are looking for, this is all you have to do. And it may not hurt to have the note notarized as well. We didn't get ours notarized though.

I have a question to ask in regards to this anyways.

Right now I'm with my fiance in her country.
I can and would like to delay my flight,
Can I submit and fix my issue in her country. I can notarize it thru the embassy here I have read. Do you think I can fix it from here, or It'll be better to fly back? If I fly back, ,who knows when we will see each other again.

What do you think? I have my NOA with me and all the copies of everything.
Can I submit everything from here, or it'll make a difference?

What are the pros-cons of doing this.

Other than depending on the foreign mail.

One of the pros is being with my fiance which is the best.

I hate the idea of going to the airport again and saying good-bye.

Are there any others? I have my roomates which I have told them once they recieve my RFE to open it and tell me what it is about. I hope so I can solve it from here.

Unfortunately, you will need the RFE notice that they mail to you. You can't just submit to them what they are asking for. You have to include the green "cover" sheet that they send along with whatever it is they are asking. Also, it gets mailed to the "RFE" unit, which is different than where you mailed previously. Maybe your roommates could fax everything to you? but I don't know if the Service center wants the original or not.
