Michael D. Young......HELP!!!!!!!
I'm so sorry to keep on about this problem, which you have kindly given advice for more than once, but I still can't get any joy.
I filed for a name change with SS in April after filing AOS, and a couple of weeks ago, I got a letter back stating that they couldn't get verification from BCIS, and to contact my local BCIS office.
All my ID's are in my married name, except my SSN and passport, which I would like to send away for a n/c before my AOS fingerprinting in Sep. I asked the agency I work for if they could put my paycheck in my married name, and they said no, because they go by whatever name is on the SS record. I don't want to have to keep carrying my passport and marriage cert with me anymore, (for fear of them getting lost/stolen, as well as feeling the need to have at least one photo ID in my maiden name due to my SS probs), now that I can use my 1 yr EAD and driver's license for ID. (Both in married name.)
I asked the lady at SS today if I could re-file a name change with them, but show my new EAD, which I didn't have before, and she kept saying over and over that my married name isn't showing on their record! "I already know this, that's why I'm asking you this question!!!!!!" AAAAARRRRRRGGGGGHHHHHHHH!!!!!!!!!
I know that BCIS need to verify my status, and I'm not questioning that, so I called the "helpline" to see what possible reason they could have for not doing so. They told me I'd need to visit Miami and find out. I'm not prepared to do this, as it'd involve an overnight camp-out, or at the very least, hours in their waiting room, which I can't afford to take time off work for.
I wrote them a letter instead, providing a copy of the letter from SS, and not surprisingly, I still haven't heard a dam word from them. Can you confirm if I can re-file or not now that I have my EAD, and if I'd stand a better chance doing it this way? I find it blatantly ridiculous that BCIS can't/won't provide verification when my EAD and all my receipts are in my new name. And also that something so simple could be so frustratingly impossible. Any advice/comfort/Prozac would be greatly appreciated. Thanks!

Well, I just went to cash my paycheck, and I can't even use my d. license and marriage cert as ID. When we applied for our marriage license, the clerk told us to PRINT our names, not SIGN the license, which is now our certificate. I went to the bank just now with my check, and she said she can't accept the cert, as it's nowhere near the signature I put on the check (maiden name, which she told me to use to endorse my check). I suppose I could always print it the same way I did on my license, but I have 4 names, and it doesn't look like a signature at all, so they'll probably get funny with that too! Anyone else ever have these problems, or is it just me whining un-necessarily?

If you got your first SSN, why do they have to verify your name again with the BCIS? Just curious...and sorry about your problems with your SSN!

Have you tried talking to a different SS office and see if you get a different answer? Maybe a different office would take the EAD. It does sound a little ridiculous, okay a lot ridiculous what they are doing to you.

Forgive my simpleminded suggestion, but can you not download a change of name form and do it that way by mail as opposed to dealing with these obviously confused people in person?

Thanks for the understanding, folks, knew I could count on you! I think I will try a different office, and see what they have to say. Thanks again!

Kate,
Your employer doesn't know what they are talking about when it comes to being able to put your new name on your check. All you have to do is fill out a new W-4 for tax withholding and there is a place where you can check mark that says your name DOES NOT match your social security card and it provides you a number to call. My SS name change is in the works but my check already has my new last name. (Too bad my driver's license doesn't )

Hi All,
OK what did you submit as proof of your new/married name and the name that
is currently on your SSN record for the name change? What did you
originally submit as your work authorization document? I assume you
received the 1 year EAD card after you had applied for the name change?
When the SSA office enters your A# or the number off your I-94 card. It
will show nothing if you are not in the system. If you are there it will
show your name, date of birth, status classification, i.e. K-1, J-1,
whether you have permanent, temporary or no work authorization, your entry
date, the date your status expires and a few other things I can't remember.
If any of that does not match the immigration document(s) you are using,
they send off the G-845 for manual verification.
If I understand you correctly, you have received your 1 year EAD card, but
your status or name has never been undated by BCIS, so the SSA office needs
to verify the person with your married name has been an EAD card in that
name.
Don't know if these numbers are still working or if anyone will talk to you
if they do, but give it a try.

The employer is supposed to record your name and SSN as it appears on your
SSN card.

Q. How can I make sure that the employee's SSN and name given to me are
correct?
A. You should ask to see the SSN card, although the employee is not required
to show the card unless it is readily available. You should record the name
and SSN shown on the card in your business' personnel and payroll records
that will be used to prepare W-2 reports.
If the employee indicates he or she prefers to use a different name for
employment purposes, advise the employee that you must use the name as it
currently appears on the card. Also advise the employee to request a new
Social Security card with a name change and to show it to you so that you
can update your records and so that your records and the Social Security
records will agree. The employee can call SSAs 800 number (1-800-772-1213)
for a new card.
Take care,
Mike

That's not going to do any good, since they will see the application she
has pending. No chance of shopping for another office while you have an
application pending.

Because SSA has to verify with BCIS that the person applying for the
name change and the person with the EAD card are the same person and
have current work authorized status.
SSA verified a person with another name and status to issued the
original SSN and card.

If you are referring to the SS-5 to change the name on your SSN record, sure
you can mail it in, but it would be a cold day in hell before I put any of
my original documents in the mail. You can lose them coming or going and
in some cases while in the SSA office. Go apply in person, unless you are
in a coma. LOL

If you are referring to the SS-5 to change the name on your SSN record, sure
you can mail it in, but it would be a cold day in hell before I put any of
my original documents in the mail. You can lose them coming or going and
in some cases while in the SSA office. Go apply in person, unless you are
in a coma. LOL

Then go into the SSA office with the original marriage license. Are both
names listed on that? That could help to complete the link that Ms. A is
now Mrs. B if the only problem with SAVE is that your maiden name is still
coming up.

Hi All,
No problem. I answer this type of question everyday at work.
I assume that by now the 90 day work stamp has expired or within 14 days of
expiring? Plus it's in your maiden name? Then of course you should go
back to provide the SSA office with your one year EAD in your married name.
Have them enter your A# and hope the new EAD/name info is there.
Take care,
Mike
