Marrying a filipina who is in the U.S. on a B2 Tourist Visa?
Is this possible? I have been talking with a filipina for over 3 years now. We are in the process of a B2 visa so she can
come here and see how she likes it. If all goes well we will marry. Is it possible she can stay here if that happens, or must she go back and then go thru the k-3 visa process? A tourist visa for a young single Philippine woman? That's as likely as
a Brazilian growing a tree. :D It's perfectly legal to marry anyone on any status in the US, but she is supposed to go back to here home country and then you file for a K-3 visa. Considering that you and her are already planning for her to live and stay in the US, I think it will be hard for her to prove strong ties to her home countries and reasons to return to her country after her visit to the US as the Us requires her to PROVE that she has non-immigrant intent. Maybe it would be better if you test the waters in the Phillipines? You can start the K-1 right away, and use the waiting time for a long vacation and getting to know each other outside the US. This option will not be easy if you are employed as few amployers like to see their employees take long leaves. |

There is no divorce in the Philippines but it is a very common scam for married Filipinas to travel to the U.S on B1/B2 visa claiming to be unmarried and single. Commonly they overstay to work and try to find somebody to marry them in order to be able to continue their stay in the U.S. A significant number of them do so. If you marry her and she turns out to be still married in the Philippines, she would be deported when she gets found in the future for fraud and misrepresentation. It does not matter that she is already married to you, a USC, since the marriage was illegal in the first place. Theirs no waiver for such a fraud. It's just a warning. She may turn out to be alright but you need to make sure before you jump in for the sake of your good future. |

Thanks for the warnings, and the "optimism". She owns land, has a good job and has already come to the U.S. on a tourist
visa two years ago. This is why I ask this question, because it is very likely she will come again on the tourist visa, and if in fact we do marry, can she stay? What do we need to do to so that she can stay instead of having to go back to the philippines first, and going thru months or years of more visas so she can come back? The visa K-1 is out there for the exact purpose you are trying to
acheive. With a K-1, you will not have to worry about proving a non-immigrant intent (and the related visa fraud suspicion that would arise if she comes as a tourist), and you will have a much greater chance of aproval. Does she know that you intent to marry her? Did you aleady propose her? If you did so, she is your fiancee. The visa application form asks her is she has a US fiance, if she answers no, she would be commiting fraud ; if she answers yes, she has a 99% chance that her application will be denied. And in general, chances for a young Phillipine woman are slim to zilch, obviously your fiance has enough ties and assets that she did qualify. Concerning the question: Yes you can get married and have here stay, but only if you don't plan this on forehand. Kind of a catch 22 asnwering yes or no to that question you see? And there are many pittfalls, as one noted, any lie at the POE may come back to haunt you later on. Search this NG for "ten feet pole". |

If you don't want to fork over $100 or so for a consultation with an attorney, then your best bet is to go for the K-1 visa. Believe me, you guys wouldn't be the first couple to spend "months or years" apart while waiting for the correct visa to be together forever. It's not as bad as you think...use the time to get to know each other even better, to fix up the house in preparation, she can use the time to visit all her relatives and friends before immigrating, etc. Best Wishes, Rene |
