Marriage and Expired Passport
An acquaintance of mine, has tried to get married to a USC but was
denied due to expired passport in NYC. His consulate, wouldn't extend
a new passport, unless he flies back to his country, or has a green
card. Is there any way, it would be possible for him to get married.

Your friend must be in the US for quite a while since his/her passport is expiring. The agent at the POE and the US Consulate will not issue visas if the holders passport will expire in under a year.
Is there a reason why your friend will not fly back to his country to get a new passport? Has he been in the US illegally and will evoke a ban if he left?
As others have stated, he can look at the laws/regulations regarding eligibility to marry in one of the remaining 49 states.
