Default Marriage based US citizenship+ immigration for parents

Hi everyone,

Anybody can help me find out how long and what is the procedure for me to
immigrate my parents and brother when I got my US citizenship.

Another, I have heard if the US citizenship is gotten from marriage, if
divorce, then that person is not eligible for file this case for parents and
relatives, is it true?

Parents would not have to wait for a visa number, so the I-130 would be
processed normally. Siblings would have to wait.

Not true...

Parents would probably take about as long as a spouse visa.
brother might take over 10 years.

Parents are immediately eligible

Siblings are 4th family preference (for most countries processing has
now started for around Nov 1992 petitions)

Hi:

Once you become a US citizen, you can petition for your parents and brother if YOU are over 21 years of age.

The procedure for your parents is identical to that for marriage visas -- I-130 followed by consular processing. Two differences from marriage visas -- no G-325A required on the I-130 and no K-3 available.

Do note that each parent needs a separate I-130.

For your brother, you also file an I-130. However, there is a numerical limitation on the number of visas allocated to this category. For most of the world, they are now granting visas to people for whom the I-130 was filed before February 1, 1992. For those born in India, the cutoff is October 1, 1990 and for those born in the Philippines -- October 15, 1981.

Please don't read these cutoff dates as "my brother can't immigrate for 12 years." The cutoff does NOT move in a linear fashion -- it speeds up, slows down and sometimes even goes backwards.

Also, if your brother is under 21 years of age, he can NOT take advantage of your parent's I-130 as a derivative immigrant. That privilege is only given to those NOT immigrating on the "immediate" relation to a US citizen.

Thanks for your answer. So divorce has nothing to do with my parents
immigrantion?

If you are a citizen, your divorce has no affect on anything
(immigration wise)
