Default Marriage In America

I am getting married in the USA in May to an American Citizen. Can someone
please tell me which Immigration Forms we need to file? We have contacted
INS a few times and just give us a load of Form numbers which might be
useful. They do not tell us which Forms we expressly need to fill out.

Can anyone help please??

Thanks

Alan

A few good places to start:

http://www.kamya.com/misc/

http://www.marriagebasedvisas.org/

These give you K-1 (Fiancé Visa) and I-130 (Spousal Visa) information. (As
well as K-3 information)

Are you currently in the US? If not then you'll need to start with the I-129F application so that you can get into the US. And if that's the case then a May wedding in the US may not be possible, as the application timeline for the I-129 is about 6 months.

I will be entering the USA for a vacation, and we have plans to marry while
I am across there, so I129F may not apply to us? What other Form do we need
to file??

Once you sucessfully enter the US and are legally married, you'll need to file these forms:

I-130
I-485 and any supporting forms like I-864
G-325A
I-693
I-765 if you wish to work while your I-485 is being processed
I-131 if you wish to travel internationally while your I-485 is being processed

See http://uscis.gov/graphics/formsfee/forms/i-485.htm and go down to Family Based Applications and see what the USCIS says you need to do.

And just a little advice: don't let any USCIS/DHS officers know about your plans to marry while in the US. It's frowned upon to enter on a B-visa and get married.

What you are planning is illegal. Not the marriage part the remaining to stay in the US and adjust status. You will be entering the POE with intent to migrate. While you might be allowed in there is no guarantee that you will be able to adjust status successfully. If discovered the consequences could be deportation.

The crux of the problem is the INTENT and you have clearly voiced your intent.

Please do take this word of advice. Although in my situtation, our
intent was not to marry. In fact, my now husband was meant to visit me
in the usa for 3 days and return to his country, but we made a spur of
the moment decision to live our lives together. We had no idea how to do
this. We relied on what I saw in the movies...get married. Not a good
idea. It is possible though while you are already over here in the usa
to become a resident, but I would speak to a lawyer. We are only paying
1500 dollars for the lawyer, so I thought it was a good deal and we
don't have to worry about the details.
