K3 Visa Process Timelines

Hi All,
I was alerted to this page in another thread on this newsgroup:

I was a bit disappointed that it doesn't state where the USC lives and
thereby give as clue as to the service center being used for processing.
I was gobsmacked to see cases of UK to US on there being processed from
start to finish in under three months! I'm assuming that these people have
been fortunate enough to be in a position to use Vermont.
Also, am I right in assuming that NOA1 is when the BCIS acknowledge receipt
of application.
Is NOA2 when approval is granted?

Andy that is correct. I have been told by my attorney that if the USC-UK
case is considered a "straightforward" case, i.e. ages of applicants,
assets, and most important, not one *day* of the applicant overstaying a
US visa (yes, one DAY can seriously impact/delay a K-3 filing!), then it
should take aprox. 3 months. There are other factors but those were the
three most important issues, he emphasised to me that if the spouse
who's name is on the K-3 application has EVER overstayed ANY kind of
visa, BCIS will look at the application very carefully and it may (and I
use the word "may" as I am not a BCIS employee and don't know the
nuances) delay or it could cause grounds for outright denial.
My atty's secy tells me countries like China, Russia, Philippines,
Caribbean and Africa can take eternity.

This timeline is for K-3 Visas only. All K-3 Visa's are first sent to
Chicago, then they are forwarded to Missouri for processing. So, it doesn't
matter where the USC lives, it will go to Missouri. This is different than
the K-1 fiance Visa which goes to a different service center based on where
you live. To apply for either Visa you submit a I-129f, so it can be a bit
confusing looking at the processing dates.
I wish everyone who posts about Visas would always indicate the type of Visa
they are talking about. I think a lot of people assume that they are
talking about K-1's a lot of the time, but this is not always the case.

Hello
That would be a great idea as I sometimes feel my timeline is getting a bit long!!
Also, K3 applicants have to file a I-130 FIRST and then wait for a NOA from their service centre (mine was Nebraska) before the I-129 is sent off to Chicago/Missouri.

Does it really matter where the beneficiary lives when it comes to processing times? My husband is from Sweden - I haven't been able to find much at all regarding timelines for K3's/Sweden/VSC.

If you're filing for a K-1, it goes to VSC if you live in that region (which I assume you do, since that's where you sent your i-130)
As far as countries go, I don't think that makes a difference for the Service Center, but I think it does for background checks...However, Sweden is a European country, so you shouldn't encounter any major delay... =)

You're correct. She actually mails the I-129 to Chicago who then forwards it to Missouri (MSC).
I think I saw some Swedish spouses on Tenni's website. Post your information (for anyone who hasn't already.)
