k3 question. tax forms filed as single when married

Default k3 question. tax forms filed as single when married

hi,

I just got 129F approved for my wife in india and she should be called
for an interview soon. here is my situation.

I am USC and my wife has never been in US before. When I did my taxes
last year, the tax guy told me to use single as filing status (and so
did IRS when I called them) so I did.

now I am worried about the I-134 support affidevit. is the consulate
going to raise questions with this? help ... who do I talk to??

I was under the impression that a married person would never file as
single.
They would file a joint return or married filing separately.

Hi:

If you are truly paranoid, get a a letter from the accountant on that.

I would check to see if filing as "single" COST you money in additional taxes.

On a related issue, we just had an adoption immigration case where INS raised an issue about the validity of the adoption because our clients did not claim their daughter [they never told the accountant and they just signed the returns without review!]. At INS's demand, clients filed amended returns for the three years in questions -- and got back over a $1,000 in refunds!

I would think if the IRS told you to put single, you're all right. If a
question arises, tell them thats what they told you. I do know that when you
fill out all those tax forms when starting a new job, it tells you to put
"single" if your spouse is a nonresident alien. So, this may be why you put
single on the tax forms and it could all be correct.

Now I'm curious who told you this and why? A non-resident alien can be considered a resident for tax purposes and filing as a married couple often means lowing of taxes (if the salaries are such that it is viable). Why would you want to withhold more taxes than necessary from your salary. The IRS isn't an interest paying account.

It just says it on one of the forms... I don't know the name of it.. W2? It's
in parentheses at the bottom of the form, I wonder if I can look at one
online... okay so it's not a W2 from what I can find. Maybe the original
poster shouldn't listen to me, I do remember seeing this on a form, for federal
taxes, when I started my new job a month ago. It wasn't on the Louisiana state
tax form.

I wouldn't want to withhold more taxes from my salary, and to be honest I'm
such a young'n that all this tax form and withholding talk really confuses me.
I apologise for confusing anyone even more. Hopefully there's someone who can
answer your question.

I have been filing "single" since our marriage almost 2 1/2 years ago since that is what I read on the form and what my accountant (been doing my taxes for 22 years) also told me to do. I finally got back a whopping 80 bucks this year so having too much withheld has not been a problem.......
