k3 expires????

Default k3 expires????

My wife's visa says it expires on the 19th. I don't understand how it
expires. I thought only the k1's were given the 90 days (to get married or
not) We are married and she came here on a k3. Does something else need to
be done?

The K3 is only the start of all the procedures - your wife needs to apply
for adjustment of status to a permanent resident (this might be conditional
depending on certain things). Basically she needs to get her greencard.

I suggest you read the K1 Faq page which also has information for K3 people

You need to look at section 14.0 Adjustment of Status from K3/K4

A K-3 visa a multiple-entry visa which is valid for two years after
the entry date. The date should be written on the I-94 that is placed
in the passport at the POE.

I just recieved the second NOA for my wife's K-3 visa and in the box
labled NOTICE TYPE: it has "Approval Notice Valid from 03/28/2003 to
07/28/2003" this caught me by supprise also...

Default time limits

There are different time limits for different stages. The 2nd NOA from the Service Center is good for 4 months, but can be extended if consular processing is delayed beyond the expiration. The visa itself, whether K-1 or K-3, is usually good for 6 months. Once you enter the country on a K-1, you have 90 days to get married and file for adjustment of status. If you enter on a K-3, you still have to file for AOS, but I am not sure how long you have to do so.

Go to the INS office that serves your area.
Too bad this wasn't noted at the POE or shortly afterward.

I talked to someone from the BCIS about what happens if the k3 expires
before the spouse visa is processed. The guy told me to file an I-553 3
months before it expires. I guess this continues it. We are through
TSC and with the processing time of 900-999 days I would say We will
have to file this in 1 1/2 yrs. I am also going to contact congressman
and see if they can get anything moving there.

WHY DOES THE FIANCE VISA GET PROCESSED FASTER THEN THE SPOUSE?????
