K3 1NOA Rejection Notice

Default K3 1NOA Rejection Notice

As the INS saga continues...My husband sent everything; I-129f to
Chicago for the K3 visa near the end of September. We received the
whole package back including the check 110$not cashed,photos of
marriage,photocopies,marriage cert.I-130 copy,etc.. a month later.
There was a 1NOA Receipt Number starting with MSC. I assume it was
looked at in Chicago in conjunction with the MSC? -Notice Type
Rejection in big bold letters. The Recieved Date:Sept 24 and Notice
Date: October 10,2003...this MSC Notice of Action had an address at
the bottom of the page
PO Box 7216
427 S.Lasalle 3rd Floor
Chicago,IL 60680-7216
The weird thing is they did not send back the I-129f form we had sent
in for the K3 and hubby is sure he included it. A letter of Oct.3rd
stated, to resubmit and attach this correspondance...due to being
unable to process it for not proper submission. My husband(USC)did
mark I-129f on the check and not detail it as for K3 and could this be
why? Where they too confused? Any one have ideas?I do not plan to
start everything over except the 129f form for K3.If we resubmit will
we retain the MSC receipt number in the wait line???

Do forms get lost easily there? I mean we sent it to the right place.
We are not going to redo and sign it for november and mark on the
outside K3. Incase it was sent to the wrong place or thought to be a V
visa or who knows?My photo M-378 spec is dated 3 months old now.
Any thoughts

Kcarz,

I guess I am confused about the whole thing. If it were me, I'd go back and carefully read ALL of the instructions and FOLLOW THEM. It sounds as if your husband fouled up in a very fundamental way if they rejected the filing out of hand. It isn't clear from your posting what is up. I wish you the best of luck.

I agree with Richard on this.
They are telling you it was rejected for *non-proper submission*.
Somewhere along the lines hubby must have made an error which would have BCIS reject it out of hand.
Just sit down with all the paperwork and start again but be more methodical. It really is worth spending that extra bit of time on this paperwork for the peace of mind you will get.

Good luck and try not to get too manic about the whole thing.

If I were you, I would prepare everything over again and be very careful. Make sure you submit the I-129f. There are other I-129 forms so be careful not to use the wrong one.

P.O. Box 7218

Also, don't forget to include the following statement (and make sure you sign it):

"Copies of documents submitted are exact photocopies of unaltered original documents and I understand that I may be required to submit original documents to an Immigration or Consular official at a later date."

Prepare a checklist. It will show them everything you submitted and why, and will help sort things out for you too.

Lastly, I would do as Richard stated. Follow their instructions. Send back a copy of the notice they sent you when you reapply. Your husband must have done something really wrong (wrong form or something else) which is obvious since you said you submitted photos of your wedding. If you had done your homework very carefully, you would know that you don't send in photos at the petition stage. Save them for the interview. There is also a section in the I-129f form that you don't fill out but just put N/A if you're filing for a K3. Perhaps your husband filled it out, and combined with the photos you sent, maybe they were confused as to what you intended. Perhaps they thought this wasa petition for fiancee (k1), which they do not process in Missouri.

You mentioned your husband sent everything to Chicago, does this include the I-130? The I-130 needs to go to your service center (VSC, NSC, CSC etc.), only the I-129F goes to Chicago.

Thats my only guess...

I also took my completed package to the copy shop prior to mailing and had them disassemble it and make an exact copy which I retained and can refer to if questions arise. And reassemble it in the exact order.

Yah so true not to get too emotional over the waste of time. I guess I
am just wondering what went wrong.I mean we did get a rejected 1NOA so
at least it went somewhere(chicago lock box?)and was looked at. I was
just hoping we could redo the 129f page for K3 and send the old stuff
back. Same Check as well...

Depending on when the check is dated or not even that, I would send another check. What happened to you sounds odd, but be greatful they DIDN'T cash your check, .

Thanks Hepa...and others for your ideas. Yes my husband did send the
copy of the I-130 1NOA
It probably was confusing for them cause I gave too much
info-photos...and he did use the correct I-129f form but put 129f on
the check instead of K3 ...they took apart the G325a's where they
were perforated. Anyways, we will resubmit and include all the info
about copies, etc...and originals at the interview....As well I will
get my husband to phone the toll free number from the US (since I
cannot from Canada) as the rejection paper advices...Hopefully a human
being will be on to give accurate info ...

Remember at this stage you are ONLY petitioning with the I-129f... you are not at the K-3 stage yet..

You apply for the K-3 AFTER the I-129f is approved and that is done in your country of residence.
