K1 VISA, Fianc?e has child. Do
Please excuse me if this question has been asked before. I have searched the
newsgroup but did not find any information about this exact topic.
My fiancée has a child born out-of-wedlock and was never married to the child's
father. She has sole custody. The father has very little involvement with the child.
He does pay child support, albeit sporadically. Anyway, my question is can we bring
this child to the US and to do so will we need the permission of the child's father.

If he is on record as the natural father, and he must be if he is paying child support, then she will need a letter from him allowing the child to migrate.

My daughter who accompanied me here on a k2 visa did not need permission from her father as we were not married and consequently he has no legal parental responsibility. This is not changed by paying any kind of child support. He is named on the birth cerificate as her father but only a court order can convey legal parental responsibility for the father if the parents are not married.
On the other hand if a letter is easy to obtain why not get one and be sure as the INS seems to be inconsistant about the way it applies requirements.

That depends on the country you are coming from. In the Domincian Republic the father
retains right whether married or not and we need his permission to leave the country
with my step-daughter. It is more for the Dominican authorities at the airport then
the consulate.
