hi,
don't apologise. you were simply sharing info.
ngh. my approved (not just filed) petition does expire before i fly. but it had
not expired when the K1 was issued. however, reading through the thread,
someone called detroit INS 3 times and got the same answer - the petition has
to be unexpired as well as the visa or the fiancé will be deported. seems they
are reading the law wrong there but what can you do?
fortunately, i'm not going through detroit. i have mailed the embassy to tell
them about this report and also confirm that it's ok to fly with an expired
petition as long as the visa is valid. i'll print out their reply and take it
with me in my hand luggage, even if they say everything's fine. at least then i
can show i've taken all reasonable steps if this comes up.
also, if detroit is getting it all wrong, i felt the embassy MIGHT do some
checking and someone MIGHT put them straight to avoid future messes.
would be interesting to hear about very recent entries through detroit because
if this is still a problem - the thread seemed to suggest it wasn't just one
officer but an official line they were taking - then people going through
detroit need to be aware it might be an issue.
regards
