K1 hopes shot down because of I-134 :(

Default K1 hopes shot down because of I-134 :(

Hi there,
Im living in the UK, and my fiancee lives in the US, we were all set
to send off the K1 packet 1, when her Co-sponser turns us down, Now I
dont think we have a hope, because she cant find anyone else to help,
She has three kids, and ones a toddler, so she cant work at the
moment, and her only income is her child support which she receives
from her ex husband.

If she sent the I-134 with the child support on to me,with no co
sponser would we scrape through?
I personally think we wouldnt, and to be stopped by one form really
sucks.

anyone have any ideas? apart from her winning the lottery?

I don't see why having a toddler means she can't work. Plenty
of people with toddlers, and even infants, do it everyday.

She may have some assets. I-864 has instructions on that. If she's owned a
house for a while, she should have assets exceeding the liability ...

I imagine you could google for I-864 poverty (groups.google.com to search
here) and see what you can find.

DOOm,

You are not going to be stopped by one form. You are going to be stopped because your wife can't support you and, for a while, you won't be able to support yourself by working, either.

How do you plan to support yourself once you are in the USA? As a practical matter it will likely be 4-6 months before you'll be eligible to work. Be prepared for the possibility that it may be even longer. Whatever resources you have to carry you through, maybe you can use them to satisfy the visa requirement that you will not become a public charge after you enter the USA.

That would bother me if it were accepted. Child support is for the
support of the children, not for the support of the new fiance/spouse.

Does she know anyone else? She can make a pool of co-sponsors.

Why would she need a "pool" of cosponsors? They can't combine incomes.
The cosponsor has to meet the requirements on their own. In other words,
only one cosponsor (or couple, I guess) makes sense, unless I am confused.

I take offence that you suggest Im going to live off the kids support
money, the reason that would be on the form is just to help me get in,
I actually have savings which I plan to use while im waiting for the
work permit.
And its no easy thing to work while you have a toddler, first of all
shes gotta make sure the job fits in with kids school times, then get
a job which pays enough to support a babysitter as well.

However thank you for the POSITIVE replys.

Did I ever state you were going to live off the child support?
I only indicated that I didn't think it should be used as a method for
showing someone has the funds required to sponsor an immigrant. It would
be different if it represented a minority of her income, but you
indicated that was all of her normal income. Not that it will happen to
you, but what happens if the government has to use public funds for the
immigrant and goes to collect from the US citizen via an Addifavit of
Support agreement? Where would the money come from?

You are absolutely right. My misunderstanding.

To the OP: you might suggest to the co-sponsor who turned you down, presumably because of the responsibility, that the I-134 is not enforceable. Only the I-864 is. I believe that this information is right.
