K1 AOS Interview question

Default K1 AOS Interview question

I recently received my K1 visa in Copenhagen and will be leaving Denmark to
be with my fiance in New York on March 1st.

Now, for the AOS, we noticed that income tax returns for the previous 3
years are required, my fiance has them but only the previous 2 are 125% of
the poverty guidelines.

Will this be a problem or can we just bring an employers letter stating that
she will be making at least 125% of the poverty guidelines this year as
well?

Bit worried of getting deported or something due to not being able to
provide the 3rd income tax return.

Hi:

Do not conflate the requirement of three years tax returns with the 125% rule. They are separate.

I've done cases where two university classmates get married right after graduation and then get their first jobs with real income. As a result they have filed NO tax returns and can show a good excuse -- no income! The job letters and paystubs show ability to support -- case approved.

Was just a bit worried since the income tax return she has from the first
year of the 3 is not above, we feel better now.
