Default K1 AOS I-94 expires

Now the question is: Is there a problem if I submit my AOS paperwork
(I-85) after my wife's I-94 expires? Today is June 6. It expires June 11.

It's probably better if you submit it before the I-94 expires, that way she has 0 days of overstay. Once you submit the AOS paperwork, her status becomes "pending adjustment of status". However, I'm not sure if that happens once you mail it off, or once the paperwork is received and the NOA is issued. Either way, ASAP is your best bet.

Best Wishes,

If the I-94 is expired, she'll have to provide a full medical report
rather than just the vaccination supplement.

An overstay of less than 180 days shouldn't cause any serious issue.

How's that? We submitted our AOS package 2+ months after Mark's I-94 expired and he didn't need a full medical OR a vaccination supplement.

Anyone catch that he's a month off? Here's hoping the OP means July, not June.

I disagree with this. The medical which is done overseas for the K-1 is valid for a year from the time it is done. It's only if they've waited to file AOS more than a year after the medical was done, that a new one would have to be obtained.

olwag,

I don't believe there is a connection between the I-94 and the medical
exam requirements. A new medical exam is required if the visa medical
exam is more than 1-year old when the I-485 is submitted.
