I've read the string of replies and will say that "whomever's" strategy is up to them. However, the non-attorney responses are not really that good.
A lot of people look for the "loopholes" in the law.
(snip)
If you intend to skate at the edge of what's legal or even skat over the line, at least engage in risk/benefit analysis.
Hi Folinskyinla!
Well, I've really started something here, haven't I? I have appreciated ALL the responses to my questions (no matter what the opinions) and I do appreciate the sincerity with which each poster replied. Thanks to you all.

That said, I feel a need, once again, to make it quite clear: WE DO NOT, and HAVE NEVER intended to LIE or MISREPRESENT out situation to an INS agent or anyone else. We are determined to see the process through to the culmination that is NSC and although dreading the waiting, perhaps the outcome will be more sweet. (Well, that might just be me trying to make myself feel better at this point, seeing as we're still several months away from even filing? )

Anyway, if anyone who read my questions thought at any time that I and my intended were being flippant about the seriousness of the situation in any way, I assure them that that was not the case. As I said before, we take this very seriously and would never do anything illegal in the first place, and certainly not anything that could jeopardize being together for always. I was simply asking questions as some parts of this still do not make much sense to me at all.

(Taking off ice skates) Don't need these then, no skating at the edge of legal for me!

Thanks again, and I hope I haven't been branded an anarchist for all eternity on this board!

If you have any particular objection to any statement I made, by all means
mention its precise inaccuracy.

I am quite aware of the issues of Expedited Removal, and have been in
multiple discussions and debates regarding ER, long before you arrived in
this newsgroup. I have studied the regulations as well as the Inspector's
Field Manual regarding ER law and procedures. In addition, we've had
perhaps dozens of examples of denied entries, voluntary withdrawals,
misrepresentations, and ER's posted in this newsgroup, each confirming this
newsgroup's (and my) understanding of ER and how/when it is applied.

The question asked was not about entry issues. It was about behavior and
AOS after entry. I detailed a response to that particular topic. ER/entry
is an entirely different topic.

Again, I repeat, if you feel I've made an inaccurate statement, by all
means, point it out. But don't expect that I'm going to delve into detailed
diatribes about ER every time the subject of tourist AOS comes up.
