Maybe. Maybe USCIS just overlooked it. I don't see how boarding passes and photos can establish anything as specific as intent to marry someone within 90 days of them entering the country (unless the photos are of the petitioner and intending immigrant holding statements of intent to that effect ).

Then again, I don't see how point 5.B. of the instructions belongs in a section entitled 'What Documents Do You Need To Prove That You Can Legally Marry'.

Those items prove you met in person (point 5.A).

Point 5.B. is a different requirement, which evidently got overlooked by the person adjudicating the I-129F.

Our advice on here is that the statement of intent should say something like:

"I, (insert name here), am free and able to marry, and intend to do so within 90 days of the K-1 visa holder's arrival in the USA."

I agree that the I-129F are lacking in what the "statement of intent" should actually say. But the instructions do say you can provide other proof to this effect. I know some countries actually DO issue a certificate which says you are single and free to marry.

But then, what you've done there is brought logic into the situation . Given that we're dealing with USCIS, the same people who, per the I-130 instructions, believe that passport photos of two people prove they are married to each another, who knows how much they actually think a boarding pass proves?!

Ah yeah I see. I'd feel better if we had one before my interview anyway as it seems we don't yet have one.
