K-1 - AOS to green card
Hi Guys,
Just a quick question.
How long are the average times of AOS for the K-1 once married in the US. Still looking into whether K-1 or CR-1 is better. Being apart for 1 year after marriage would be crap but if its easier and cheaper then it may well be he sensible option. How long does it take to change your AOS from K-1 to PR & Green Card. Also i understand at POE, only NYC stamp your passport for work on the K-1 correct??? then how long does it take to get the work visa under the K-1?? is it 30 days after marriage??

Once the person enters on a K-1, they need to marry within 90 days and file for AOS as soon as possible after that. How long it takes for the AOS interview depends on the backlog at your local office. It could be as fast as 3 months, could be as long as 12. I'd say normal wait times seem to be around the 6 month mark or so.
Yes, JFK is the only POE now that gives the 90-day temp EAD stamp.
Part of the AOS package includes an application for the 1-year EAD. After you file AOS, it takes about 90 days to get that 1-year EAD in hand.

Warning ahead (psst Rene).. there is word on the street, nothing official yet, that the JFK EAD stamp for K-1 entrants really will go away this Spring.
Watch the I-9 updates on USCIS.gov, I reckon it will go away when that change is official.

Filed AOS - Early February 2008
Received EAD and AP - Early April 2008
AOS Interview - early June 2008
Green Card - late June 2008
We probably could have shaved off four weeks in between the medical and interview since DH held on to paper work because (believe it or not!), the process was moving too fast for our personal timeline.

So would the K-1 route be more sensible as it only take 6-8 months for the greencard and you dont really need the green card immediately any way right? and the CR-1 is a bit extreme living apart for a year or so.

Each way has its own advantages and disadvantages. It's really whatever works best for you in your own unique situation. My fiance and I did the K-1 visa because i was not prepared to get married when I went to visit him, and we wanted to get started on the fastest way to bring him here. I had a choice of starting the K-1 process immediately upon my return to the USA, or wait until I could afford another trip to visit him and get married. We chose to start the process right away, as I probably wouldn't have been able to make another trip for at least 6 months to a year later.
