My fiance is coming to the US. When he proposed we were supposed to
meet but weather and time constraints didnt allow it. I was told I
could submit the papers for Fiance Visa while he is in the states, and
then he has to go back to Portugal for interview and medical. I am
confused as everyone says something different.

He is coming to visit and I thought of surprising him and getting
married. Will that affect the immigration process for me submitting
the !-130. Wouldn t he be protected under LIFE? We just dont want to be
apart for more time.

You can get the ball rolling now, but he'll have to show that he doesn't have immigrant intent on the visit at POE.

Hi,

You would be able to file the I-129F for the fiance visa while he is in the USA, that's not a problem. He would then return to Portugal for the visa processing and interview, then return to the USA on his K-1 visa. You'd then have 90 days to get married.

Or, you can get married while he's here on vacation, and submit the I-130 for spouse immigrant visa. It is basically the same process. He will return to Portugal for his visa processing, and then return to the USA on an immigrant visa.

Basically you'll be separated no matter which way you go. The question is, would you rather be separated as an engaged couple, or a married couple?

p.s. - the K-1 might be a little faster in getting him to the USA, but there will be more paperwork to file once here. With the immigrant visa, no more paperwork in USA.

Hi:

"LIFE" has nothing to do with it. If he comes here on that visit -- make an appointment to see an experienced immigration lawyer and discuss the issues.

No smart lawyer will discuss the issues ON LINE in a public newsgroup. At least THIS lawyer won't touch those issues with a "10 foot pole."
