Here's how it goes .. (I have no idea if your charges require a waiver or anything, just commenting on the process)

Your wife petitions you (I-130). You wait about 6 months. You submit the visa application documents and go to an interview in London.

Consular Officer says 'oh, you are ineligible for a visa'. You need to apply for a waiver of these ineligibilities.
You say 'oh bummer. Here is my application for a waiver (I-601).
Officer says 'OK, thank you very much, we'll be in touch'.
Wait another (?) 6 months (this varies).

Ruling on waiver = favorable: Get a visa
Ruling on waiver = fail: Get a new plan

Waivers are an immigration law specialty. You *really* want to work with someone who has already had several successes under their belt. The waiver forums at immigrate2us.net have tremendous resources gathered for this specialty--example letters, a community familiar with the lingo & process and a couple of lawyers who generously give their help and specialize in the topic.

Go read the sticky posts---read, read, read everywhere, and don't expect that you'll be able to get pat answers to your questions.. yours are complex and individual to you.
