Default I'm trying to get my husband to the US

Hi all!!

Here's my story: I'm a permanent resident in the US and have been for 19 years. I
recently married my husband, who is a German citizen while he was here on a visa
waiver. We've applied for the "husband visa" and I just filed for naturalization. Is
there any way at all for me to get my husband into the United States? Or do I have to
wait until I'm naturalized? Ugh, I'm dreading the responses...

I'm sorry to confirm your dread of the answer, but you have a long long wait in store for you to have him come to the US to join you in marriage.

He is not eligible for the V visa under your petition is three years in the works. As a PR you have to wait for your quota number to become current and that can be three to five or more years down the line. Your best bet is to file for naturalization and hope you get that quickly (one year or less). Then you can update your I-130 to immediate relative of a USC.

IF you wait until you are naturalized, it will take an addition few months to year or
more. If you file now, you would have to wait about 6 years to get him a spouse visa.

Why haven't you applied for U.S. Citizenship yet? I don't understand why anyone
would do this.

You could file for his Green Card now. When you get your Naturalization, the petition
will be moved to Immediate Relative category.

You could check out how long this Naturalization process is taking at your INS office
by visiting: http://www.visapro.com/INS-Processing-Times.asp

What would the benefit be of applying now except to tell INS that he is a potential
immigrant when he tries to enter on a tourist waiver so he can have a bigger risk for
entry denial?

Because that way, she would lose her German citizenship for good, and with any EU
citizenship, you can work and live anywhere in the EU. However, since January 2001,
you can try to retain your German citizenship by applying for permission from Germany
before filing with the US. That might have made the difference in her case.

Just guessing.

Well, I've already applied for his i-130, which I now realize was a mistake. So we
have to wait for me to become a citizen.
