Illegal - Immigration through Marriage! How-To?
Hi, I have entered USA 2 years ago with an F-1 Student Visa, and didn't
register for school after June 2002 which was the end of spring 2002
semester, as far as I know I had 3 months time before I became illegal in
the country, which means I was legal till the end of August, so I'm illegal
since august. Anyway I got married to my girlfriend about 2 weeks ago which
was December 9th. What I'm trying to learn is, firstly what should I do to
get a Green Card (and how long does this process take) and I heard that
people who were illegal before marriage do not have the rights to get travel
papers before 2 years, is this right? I need information about all these...

There is a technicality, I think, which may apply to you:
IF your I-94 states no date for expiration but instead has a "d/s"
there, then you are not out of status until so ordered by an immigration
judge. You might want to discuss that with an attorney to confirm it. If
that is the case, then you are not illegal yet. However, it's not wise
to take my word for it, see the attorney and be sure. And file for AOS,
NOW, providing that your new wife is a US citizen. If she's not a
citizen, then you cannot file for AOS.

Yes, it says D/S on my I-94, and my I-20 is valid till 2004, but as far as
I know if you do not register for classes latest 3 months after the
complatition of last semester, than your I-20 is not valid anymore ( that's
what I heard, not sure!) and yes my wife is a US citizen, born in the US,
her parents were born in the US too, and she even have some native american
blood ( I heard that's helpful, nor sure though ). I'm going to apply after
new year, but don't know if I should apply for AOS or something else + can
not really afford an attorney

If I'm understanding correctly, you have been out-of-status since the fall
semester began, because during summer you are under no obligation to attend
school.
If you file forms I-485 and I-130 today, then your out- of -status period will
be 4 months at most, so the reentry bar will not apply to you and you will
have no problem
obtaining advance parole document to travel inmediateley.

years AFTER you become a citizen.
