Ok...I had been living with my husband (USC) in the USA and was granted a 2 ear provisional green card. For various reasons we both decided to return to the UK in august this year. My greencard is due to expire in December. We had thought about me returning over there and renewing it but I just found out I am pregnant and decided its best for both of us to stay here as we have no benefits in the USA as my husband left his job.

However...we are both quite happy to stay in the UK my only question would be will I be allowed back into the USA for holidays if I let my greencard expire? Is there someone I should notify that I don't want to renew it? I'm just afraid if I return to the USA for holidays they might see I have an expired greencard and get suspisious of me and deny entry or something.

What do you think?

PS...also...if in a few years we decide to return to America will I be able to get another greencard?

Hi

There is a form you need to complete, the I-407
http://www.usembassy.org.uk/dhs/uscis/abandon.html

you can send it to the US Embassy in London along with the greencard. They will send you the form back for your records, keep that form in a safe place as it has come in handy when/if you plan to visit the US on VWP.

We returned my husband's in 2005 and we are currently in the process of doing a Spouse visa DCF via London for us to return to the US.

From what I've heard, if you fail to file form I-751 to remove the conditions on your status, you will cease to be a PR the day your GC expires.

If you're otherwise eligible to visit on the VWP, yes.

No. However, as the member above said, you should file form I-407 to formalize your intent.

ig,

I think that if you do not plan to retain your PR status that it would be best to clearly make that known to the authorities to minimize the potential for future problems. File the I-407 as kn8 suggests, keep the acknowledgement with your important papers, and take a copy of the acknowledgement with you on your trips to the USA should there ever be a question about your status.

Sometimes people break some eggs on their way to the conditional green card. That can create complications when trying to be a visitor again. The safest bet would be to seek a visa and abandon claim to permanent resident status at the same time.

Of course the VWP could be available to you, but you have not provided enough information about your history for us to delve into the matter.
