Default I want to marry my boyfriend in america

oh god someone please help me .. I am so so worried.
Ive tried to post something on here all day, I hope this works

I am living in the UK and have done all my life.. Im am currently going through a divorce. I have known someone in america for two years but we have been in a relationship for just over a year.
We have been flitting back and forth to see each other when ever we can. We love each other very very much and want to get married as soon as my divorce is through.

This is where we start to panic!!
I am here on my own, with three children, the youngest being six. So I am on all benefits right now. Ive made calls to people for advice and they say because I am on benefits they will not let him come to me. Which scares the hell out of us!

If I get a job.. here in the UK which I want to do.. no job is going to cover the amount the goverment say you have to have to care for myself and three children.. so either way I am still going to get the working tax family benefit no matter what... (most married couples who are both working EVEN get that)

He has no savings at all so he cant show he can support himself till we get married and gets a job... which he wants to do.. he wants to work!!

What do we do? I cant tell you how desperate we are... we dont know which way to turn.. we dont know if the immigrations will take into consideration that Im on my own with three kids and the goverment says I still have to have some kind of benefit.

Im so frightened this will stop us from ever being together, we love each other so so much, and my kids adore him. Even a works payment ive heard will be difficult cause hes what we call a panel beater and that dont come under the catagory.

Please help!!

Nicky

Nicky: Don't take my word on it because I'm not a lawyer but here is an answer we got for our situation.

My husband is British and I'm American. We found out through immigration that you have to file a form of financial support. If you don't make enough money, you can have a sponsor help you. My husband was between jobs and didn't have any savings so it was clear to us to get married while he was in America on a visitor waiver visa since I worked and had an apartment and vehicle and money in the bank. I don't believe immigration will not let you get by if you or him don't have the means to support the other one. America or England does not want people on public funds so that's why you have to show financial support (either yourselves or having a sponsor). Call immigration and talk to an officer that maybe can help you. I'm sure there is a way you can get together. Don't give up hope.

Hope this might help you and good luck,
Kady

Nicola,

In respect to getting married. It may be better for him to file a Fiancée
Visa for you. This means that you won't have to go through the problems that
myself and my wife are experiencing, as we are already married. In respect
to finances, ask him if he has a relative that would be willing to file the
Affidavit of Financial Support. It is the same as getting a loan from a
bank, you need to have the funds. If you don't you get a guarantor to say
that in the event that you can't afford to make your way, they will finance
you.

Matt thankyou for the reply...

But I have a question to ask.... well maybe a couple!
you say a relative.. now does it have to be a relative of his or can my sister sponser him? and you mentioned a guarantor who will help us?? who is that? and how do I go about it?

and for anyone else out there reading this...... is there anyone else out there that has been in the same position as me... a mum with three children and on state benefits.. Im going to find a job but UK goverment say you have to earn quite a bit of money these days before they dont offer you help.. so either way.. I will be on the child tax benefit no matter what and Im worried about that. Anyone? pleaseeeee?? I cant be the only one in the world

Nicola,

Go to the INS website and go to online forms section. You are looking for
Affidavit of support - this will let you know what is what in respect to
what the INS want. Also contact Overseas Emigartion Service
www.overseas-emigration.co.uk . There is a list of contact offices under
there contact section. They should be able to advise you. There may be a
chance and a slim one at that, that the catholic church runs an information
service. I think it is predominant within the Irish community - if you know
of any Irish clubs they may have that information. And hey if you aren't
Irish they won't know by your accent. Check this site out

Just a quick note to say that from April 2003, Working Family Tax Credit becomes Working Tax Credit and Child Tax Credit. These are NOT benefits in the true sense of the word, but rather a "discount" on your taxes, to take into consideration families on low incomes. They are paid through your employer, who deducts the payments to you from their employer's tax bill. This is different from benefits, that are paid through the DSS (Dept. of Social Services)

Don't let WTC/ CTC put you off trying to get married!
