Default I want to marry him. How do I do it?

OK..everybody made very good points and thanks for the input! So..We
want to get married!How do we do it and live here in the USA. I live
in Gainesville,Georgia about 1.5 hours above atlanta.There are many,
many illegal mexicans here. I work in the mall selling cell phones and
I worked in Walmart. I speak fluent spanish and I know most of these
mexicans. They use other SS#'s and fake names, they buy papers and
false licenses. However my fiance has never chosen to do that. He has
the 5 arrests for driving without a license and that was his only
crime. No dui or anything like that. I want him to be able to have a
drivers license and social security # so we can live as normally as
possible here in Georgia. Although, I could teach english in mexico, I
have been there before and I like it but I have a 12 yr old here and I
don't want to take him there. There are ALOT of people here who marry
illegals apply for status...are they able to do this??? Without
245i??? How can we marry and have him a license and ss#?? I know you
can buy a house here with only a Tax ID .. I am also a real estate
agent, and you can file taxes with this ID but you can't have a SS# or
license.... Help Me please!!!!

Not possible if he enetered illegally, if he came in on a visa, then you can.

You need to hire an attorney to sort out everything here. I remember that
you posted before, and there really isn't much new I could add.

US Law is very clear, entering illegally is not looked favorably and
they penalize those people heavily. Nothing stops you from getting
married if you qualify for a state license, however you will not be
able to petition for a green card for him.

Only a really good lawyer can tell you if there is any hope, but it is
unlikely

As for social security numbers, now they are really hard to get, even
students here legally can not get one unless they work at the
university and get paid.

Driver licenses are state issued so each state has its rules, at least
in NY where I live you need to prove you are here legally (i.e. green
card, visa, etc.)

Well the penalty is just a waiting period .. which he could do his
waiting right here...illegally of course...but he can establish a life
right here while he's waiting for legal status. What a joke this is!
But I guess it's the immigration game.He can get a drivers license in
North Carolina with a license from mexico. That one is an easy one and
he can buy a house with a tax id #. But right now he doesn't pay taxes
and I could actually have his checks made out to me to document his
income as my income as an independent contractor. Actually, alot of
the lawyers are crooks and liars as I went through them in my divorce.
They lie for money and take of advantage of those who don't have money
or who are gullible enough to believe them. It's better to get advice
from those who have actually went through the process which is why I
am here but there not any posts about marrying people who are
illegally in the US and came here without documents and have dealt
with this through the mexican consulate. But I hope my posts can help
someone who has not done as much research as I have.

He can't. The waiting period doesn't start until he leaves the US. If he
then returns before the waiting period is over, there will be hell to
pay... And the ban will start over.

I am very sorry for your situation, but the options you are thinking
of are not feasible and without being and expert I would think that
you might end up being an accessory to a few crimes which might or
might not get you in trouble

Immigration law in the US is very restrictive, and more so after
september 11th, and I don't see it becoming easier. I am from Mexico
myself and have simpathy for all other Mexican here - but your
reasoning that tbecause they are so many illegal ones here a
procesdure should exist is flawed - congress will see that as a
justification for restricting the flow since there are too many and
pass laws against it rather than in fvor of it (and that is what they
have done over time)

There are many free immigration resources in the US, and I am sure
Atlanta being a big metro area has many places, you should find them
and consult them before doing anything, especially if you have hope of
eventually legalizing his stay - Don't underestimate the resources and
abilities if BCIS (or INS) - assume they will find out if he has been
illegally here after filing papers, they will catch him lying and ban
him for life

I am not trying to scare you, but INS and consular officers are well
trained, I have witnessed many instances where they easily found out
about lies. (Anyone who has been to Mexico city consulate many times
or who like me has to go to secondary inspection to be admitted under
advance parole has many similar stories)

I do wish you best of luck, but if you are commited to being together,
it is likely that you will have to wait for a long time or live in
another country

Does anyone know that they are trying to extend 245i until april 30,
2003 per Senator Daschle?????

Please talk to a qualified immigration lawyer and get some advice before
you do anything.

FWIW, driving w/o a license may or may not be a CMT (crime of moral
turpitude). CMTs result in inadmissibility; non-CMTs don't have
necessarily the same effect.

I agree that the fact he is EWI is the biggest problem.
