I need your advise to file I-485
I came to U.S. with B-2 Visitor Visa in 2000 and changed my status to F-1 student visa in 2001. And I got married in July 2003 and my husband is U.S. citizen and I am still full time student.
Now I am trying to file I-485 form by myself and I have some questions for sure.
Q: Which application type should I check, a, b, c, d …..?
Q: I also have two I-94s, one is from when I came to U.S. with B-2 visa and the other one is from when I changed my status to F-1 visa. My question is which I-94 should I use to file I-485 form? Both I-94 # are same but expiration date is different. On F-1 of I -94, expiration date is “D/S. Can I put it down for the question “Expires on?
Q: What should my current INS status be? I think it would beF-1 since I changed my status B-2 Visitor to F-1 Student. Is that right?
Q: what do I answer for the question, “In what status did you last enter? Should I put downB-2 Visitor orF-1 Student. I’m pretty confusing in this question.
Any other suggestions or advice from you will be greatly appreciated!!!

We were told to check "a" on my wife's I-485, because I was concurrently
filing an I-130 which constitutes a "a relative, special immigrant
juvenile or special immigrant military visa petition filed with this
application that will give you an immediately available visa number, if
approved.)" That's because an I-130 for a spouse is a "relative visa
petition".
Can't help you with the rest.
Gratuitous advice: if you go the easy way and xerox four copies of the
"biography" form, be sure to put an *original* signature on each copy.
Or download your forms http://visapro.com/INS-Forms-Download.asp and
fill them in on your computer. These are much better "computer
fillable" forms than on the CIS website.
Good luck with it,
Joe

Kate, if you are applying for adjustment based on marriage to a USC, you are allowed to file the I-130 and the I-485 at the same time, so in that case, you choose (a) for Part 2.
It sounds like your current status is F-1. So, put D/S down for the expiration date of the I-94. The I-94# should be the most recent one.
It sounds like you last entered on B-2, so put Visitor or B-2 on Part 3.
You might get better answers to your future questions in the
alt.us.marriage-based.visa group.

a.
I assume that you know that your husband must file Form I-130 simultaneously
with your filing of the I-485, at the USCIS District Office for your
residence.

Both. These two documents, together, now constitute your I-94.
Both I-94 #

Yes.

If you never again entered the U.S. after the date that you entered in B-2
status, then the answer is B-2.

Be sure to file Form I-765 and I-131 at the same time so that you can get
permission to work and to travel outside the U.S., after the filing of your
I-130/I-485.
Keep a photocopy of the entire package and mail it with a proof of receipt.
Consider having an immigration attorney review the package before you send
it out.
