I-864 Sponsorship
Hi everyone,
I was wondering if anyone could clarify something for me.
Going through the drawn out process of AOS from K3 and was wondering as my wife (the USC) cannot meet the requirements, then would it be acceptable for my brother-in-law to act as sole or co-sponsor?
They both acted as co-sponsors on my initial application for the K-3 (I-134) and that was obviously not a problem. I'm hoping this would be the case too...

Your wife must be your sponsor even if she doesn't qualify, so she will still do an I-864.
Your brother in law can be a Joint Sponsor as long as he is a USC or US PR, age 18 or over, and living in the USA. He must earn the right amount for his household size plus you. He will do his own separate I-864.
