Default I-864 help

Hi folks
It's got to the stage where my wife and her father will be filling in their I 864's for my sponsorship.
Are there any links, hints or tips you can give them?

She filled my application to London and we received approval a few days ago.
She has since moved back to her families house in Houston since filling and I have stayed behind, herself and her father are filling in the forms now to help make things quicker when the case number arrives.

Any help in this matter would be great

All the links, tips & hits required are in the I-864 instructions - start there. If they have any specific questions, post back

Everything they need to know is at www.uscis.gov, Forms, I-864 and I-864P.

Hi again
My wife and her father have filled out most of their I-864's
My wife is asking about her tax returns.
She didn't file for the past 2 years as she was a student in the uk and didn't earn enough to file. She has written a letter explaining all this as required.
Will she need additional evidence?
Also she can't seem to find her 2010 return, is this required?
She has just signed a new contract of employment and will be sendings a copy of it along with her forms.
Her dads is all in order it seems.
Any help will be great fully received as always.

Not likely, but just in case, to support her claim, she can go to www.irs.gov, and print the page that states someone earning less than $xxx per year is not required to file a tax return. Sorry I don't have a direct link to that page.

The instructions for the I-864 ask for the sponsor to include the most recent tax return. If her most recent tax return is 2010, she should include it. If he can't find a copy of the return, she can get a free IRS official tax transcript. She can order it by phone, the number is at www.irs.gov.

She has just signed a new contract of employment and will be sendings a copy of it along with her forms.
Oh, she's employed? In that case, does she earn enough to cover sponsoring you herself, without needing dad as a Joint Sponsor? If so, have her submit a letter from her employer (not just the contract), stating her title and yearly income, and that the position is full time permanent. Also have her include a few paystubs to prove she actually gets that amount of income.

Since the job is so new, you might want to go ahead and take the Joint Sponsor's I-864 to the interview "just in case", but if the ConOff feels your wife qualifies on her own merit, you won't have to use her father's I-864.

Also I have been asked to find out about household size.
Her dad has put everyone on his, including me as requested.
Will my wife also put everyone on it? Or just me and her?
We will be living with her parents for a short while so I assume its everyone as its a joint sponsorship.

Your wife will just be you and her (assuming there are no children)

Great. It's A brand new job so no payslips but there will be a letter from her employer.
I was aiming to have her dads as a back up just in case.

As always a great response. :-)

See the I-864 instructions here: http://www.uscis.gov/files/form/i-864instr.pdf

Specifically, Page 5, Part 5, Sponsor's Household Size.

You only received the I-130 approval a few days ago, so your interview probably won't be for another couple of months. By that time, she should have a few paystubs she can scan over to you. It's best to include them.

Another query from the wife via Skype.
On the I-864 her dad is filling in, on part 6 no13 a-c it asks for his total income as stated on IRS form 1040EZ, but her mum and dad filled a joint tax return so the adjusted gross income is combined.
She is now unemployed and no longer contributes. Her dad still earns more than needed.
Does she have to fill in an I-864a as she is listed on the tax return and just state now unemployed?
As they can't seperate

Hi jeff, by everyone I meant his wife, son, daughter and me.
As we are using it as a back up if my wife's own form needs a joint sponsor I will have it at hand.

No, mom doesn't need to do an I-864a, since she's not including her income along with dad's on his I-864 to meet the income requirement. Dad should list the combined income on the I-864 for the last tax year, as shown on the tax return, but he should only list his own income under "current income". He should put together a little chart regarding the breakdown of income on last year's tax return (how much was his, how much was hers), and perhaps include a few of his current pay stubs to prove what he currently earns, on his own.
