I-765 and L-2: should the last I-94 be enclosed if the applicant is abroad?
I am an L-1 holder and my wife would like to obtain the EAD under the new changes in
immigration laws. My company's lawyers do not help with this, but the procedure does
not seem complicated.
One issue that we faced was item 10 on I-765: "Alien Registration Number (A-Number)
or I-94 Number (if any)". My wife just left the US today and will obtain a new L-2
visa (extension) abroad next week. She is planning to stay abroad until her EAD is
approved. She filled out and signed I-765 and signed the Signature Card. She is
planning to mail everything to the Vermont Processing Center after her L-2 extension
is approved abroad (should be a formality since I got my L-1 extension already).
Here is the question: under item 10, should we include her I-94 (she made a copy of
I-94 before her departure)? Since she is abroad, I am thinking that we should not
enclose the I-94. However, I do not think she has an Alien Registration Number (not
sure what it is). Should we leave item 10 blank, then?

You are right, do not include the I-94. The Alien Registration Number is something
that is assigned when you apply for a Green Card, or are in deportation proceedings
or in a few other situations. Like a Social Security Number, it is valid for life.

You are right, do not include the I-94. The Alien Registration Number is something
that is assigned when you apply for a Green Card, or are in deportation proceedings
or in a few other situations. Like a Social Security Number, it is valid for life.
