I-765 Application for Employment Authorization
Questions, questions, questions! My fiance is here now in the US
on a B-1 visa, until March 2004. I am currently waiting out my
divorce which should be finalled in February. Can my fiance get
authorization to work NOW? Or does he wait until our marriage
in late February? Or must he wait until the interview/approval date?

I assume he will be filing to adjust status from the visitor's visa. In that
case he files the I-765 with the I-485 (and your I-130) after you have got
married. He cannot get authorization until then.

case he files the I-765 with the I-485 (and your I-130) after you have got
married. He cannot get authorization until then.

He won't be able to work until he comes in with a fiancee visa or gets any
of the work authorized visas (H1-B etc.).
For you to be able to use the fiancee visa, of course you will need to be
divorced first and show proof of that.

Addition... or until you get married and apply for Adjustment of Status (in
this case it takes about 90 days to get the EAD depending on where you
live). If he came in to US on a K-1 visa, then he might be able to get the
EAD stamp on his passport at port of entry.
