Default i-751California

I filed form I-751 nov 2004. received notice that my alien card has
been extended for one year and that i may contact the service center if
i hear not back within 11months.

11 months passed. in the meantime i received a letter answering one of
my phone inquiries stating that i would be contacted as soon as a
decision is made.

questions:
1)what is my status if i do not hear back and my alien card expires.
2)would i still be allowed to work
3)what can i do to speed up the process

Hi Gig,

1) Conditional Permanent Resident. Your card expires, but your status does not.
2) Yes.
3) When you are eligible, you can apply for citizenship. That way it will force your I-751 to be brought up for adjudication.

I read posts here that lot of I-751s at California Service Center being processed pretty fast. And I dont mean to scare you, but I was wondering if other I-751 filers in CA are going throug the same?
Does it matter the location, i mean if two people file, one from Southern CA and another one from Northern CA but to the same Service center in Laguna, would speed be the same?

Not the same results, no...but they process them in order of receiving (supposedly...lol), so it's not like south gets processed faster than north, for example. But, there's no way of knowing which one will end up getting processed first.

Or, if you and I had files received on the same day, but my case took more investigation than yours, so yours completed first.

There are a million reasons why files get completed in different orders; it doesn't indicate they're being done out of order, IMO.

visajourney has started autolinking file-completion predictions to their members.. bad idea for the same reason. Who knows exactly when your file is going to complete???

If your extension letter is getting close to expiring, and/or your Service Center processing dates are 30+ day past your NOA date, make an InfoPass appointment to go to your District Office. You can get an I-551 stamp in your passport as continuing proof of your status, which has NOT expired.
I encourage you to do something *before* our letter actually expires, so you are not left without proof of status.

Since your status never expired, you may continue working.

There is nothing you can do to speed up processing, unless the SC is posting a date that is +30 past your NOA date. If so, you should check up on your file to make sure they're still working on you.
Additionally, as Rene said, file N-400 which will cause your I-751 to get pulled up. Make sure you meet all the other eligibility requirements before you file
