Default I-751 proof

Reading through the forums and searching for I-751 also but I wanted to ask...

We're mailing our form off tomorrow (CR-1 visa) and including the following as proof of our ongoing marriage..

• Copy of passport with visa
• Copy of green card
• Settlement statement for our jointly-owned home purchased July 2013
• Copy of 2013 joint tax return statement
• Copy of joint installment bill for state income tax
• Copy of joint bill for 2013 tax return
• Copy of Merrill Edge account confirmation showing joint trading account
• Copy of joint Delmarva Power bill for our home
• Copy of birth certificate for our son
• Several photos of our family and relationship

Anything else?

No need for passport and visa copy.

Make sure to include evidence from the time you became a PR (not just the most current bill, for example).

You mean like an old bill and a new bill?

Hi Rene,

This one piqued my interest since I'm slowly gathering evidence for my own I-751 Removal of Conditions process -- I don't want a mad dash when the time comes to submit.

It was only after about 6-8months of living in the US that my wife and I began to actually have any documentation with both of our names listed [utility bills, bank statements, etc]. Certainly we have photos of us from that initial season in the US [on road trips, on dates, with family, etc] but nothing 'formal' per se.

Do you see that as a potential issue?

• Copies of on-going statements for Sam’s Bank of America credit account of which Heather is an authorized user for the following months / years:
o Monthly statement 11-2012
o Year-end summary 2012
o Year-end summary 2013
o Monthly statement 06-2014
• Copies of on-going statements for Ashley Furniture Homestores / GECRB account which h joint responsibility for the following months: 08/2013, 12/2013, 04/2014, 07/2014
• Copy of birth certificate our son
• Several photos of our family and relationship

Theres about a dozen photos and they are chronological - starting from when he first got here, to then me being pregnant, us moving to our home, us with the baby, etc etc. You can see hairstyle changes and weight fluctuations through the course of the years

How worried should we be about this? Should I try to gather more?

No.

I sent

- a copy of birth certificate of our daughter (born during 2 years).
- the car insurance card from my glovebox.
- the first page of our turbotax printout of our recent return.

Don't worry about it. Perhaps Mr. Folinsky can chime in, but I read somewhere that the 751 is a formality - the dark forces are much more concerned with the first step of getting the greencard.

The amount of documentation needed is a judgement call -- often determined on a "case-by-case" basis. Also, if the minions of the Dark Forces consider the evidence submitted to be insufficient, it is not the end of the world -- an RFE will issue and in the meanwhile, the non-citizen is still an LPR.

When I was in practice, I would try and have some mercy on the adjudicator who had to read our submission. Quite often, the amount of evidence need not be all that much. I recall one case where we put in the closing statement on the house closing, the kid's birth certificate and the joint tax returns. Approved without an interview.

It pays to remember that a certain small number of I-751 applications are referred to local districts for interviews just as quality control.
