Default I-130 Questions

Hi,

I have a few remaining question for my I-130 form. Any advice much appreciated:

i) "Has your relative ever been under immigration proceedings?" I am currently H1-B. Should I enter Yes or No?

ii) Section 22 of the form asks: "Complete the information below if your relative is in the United States and will apply for adjustment of status:
Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in:"

I live in NYC. What do I enter here for the USCIS office info.?

iii) For questions on the form such as "If your relative's native alphabet is other than Roman letters..." and "If separate petitions are also being submitted for other relatives, give names of each and relationship", if the answer is no, should I enter "No", "N/A", "None" or just leave the space blank?

Hi:

If you are here on "H-1b" status, then you don't qualify to file an I-130. Hence, it is not "my" form. However, assuming you are the "beneficiary" for whom the I-130 is "for" --

i. You don't give enough information -- if you were previously under deportation, exclusion or removal proceedings but are now here as an H-1b, then say "yes."

ii. This is not really an important question -- if you will be applying for adjustment in New York, then put put New York.

iii. If the answer is "no" then put "no" -- on the foreign alphabet thing, it not applicable, leave it blank.

Sorry, I should have provided a bit more info. My wife is the US citizen and I am the H1-B sponsor (beneficiary) who is filing for AOS. This is really her form to file, but I am preparing it on her behalf.

For question i), I am currently an H1-B visa holder and have never been under "deportation, exclusion or removal proceedings". Just to confirm, does that mean I answer "yes" or "no"?

I'm no expert, but that seems to be a mass of contradictions.
An H1-B sponsor, as far as I know, would be a company seeking
to employ someone using an H1-B -- that person being the
beneficiary.

So you're not the sponsor, from what I understand. You might
want to try to use less jargon and explain in more detail if
you're looking for helpful advice -- and always be aware of
the difference between opinions stated on a newsgroup and legal
advice (a distinction which confuses many, it seems, including
some with a professional interest).

Thanks James. You are right. I re-read my original post and it makes absolutely no sense at all. Simple facts:

* I am currently working in the US on an H1-B visa.
* My wife is a US citizen.
* She will be completing the I-130 as the petitioner with myself as the beneficiary/relative.

I also re-read Folinskyinla's answer, which I think covers my main concern: "Has your relative ever been under immigration proceedings?". i.e Have "I" ever been under immigration proceedings? I will mark "No" for this as I haven't ever been under deportation, exclusion or removal proceedings.

Can you confirm whether this is correct? Thanks

He has already answered your questions in the simplest way!
It is you I believe who is acting like an ASS!

YES means YES, that is when an event or condition is true in the context of
the question asked!

Do we have to also explain to you what NO means?????
