I-130 Question 13 - ever been to the US

Default I-130 Question 13 - ever been to the US

I have a question about question 13 on the alien relative side of the I-130.

It asks "has your relative ever been to the US?" - well, she lives with me right now
so the answer would be YES, right? I am only questioning it because I thought it
could mean prior visits to the US and not whether or not she is here now.

On the Doc Steen online filable form, if I check YES to question 13 it also checks
question 16 as yes - "Has your relative ever been under immigration proceedings?" -
since she entered under the VWP, that's not true, right?

I'm confused!!

answer "yes" to question 13 since she is here in the US, and if it
automatically checks "yes" to question 16 and she entered on the VWP, just go
and un-check it manually.
