I-130 or K3?

Default I-130 or K3?

Back in August 2002 my wife and I started the K3 process. After many problems and mistakes caused by myself (sent to wrong addy) and the INS (then lost my original app) my (2nd) I-129f was finally approved this past Feb 12, 2004.

Since my I-129F was approved in Feb. my wife in South Korea has not received her packet.

Now the I-130 that I sent with my original K3 application back in August 2002 is approved.


Should I continue to wait on the K3 packet to arrive in South Korea or should I pursue the 1-130 route?

It seemed that it is taking too long for the packet to get to South Korea. I called the NVC and asked about the delay, they refused to give any info, except to wait three months to call back, like the approval notice said to do.


Any help would be appreciated.

I would go with the I-130 at this point. Both will processed virtually
identically at the consulate, but if you use the I-130, she would arrive
in the US with an immigrant visa and get her Green Card immediately. That
would save you all the AOS headache afterwards.

You may want to contact your local Congressperson, if you really want
help. But given that the I-130 is approved, I would simply ignore the
missing packet altogether and wait for the I-130 packet to get approved
instead.
