Yes you are right that was my only confusen
before I was thinking my I-130 has to be approved first . but as you said I
filed I-130 and I-485 togather . so it's mean once my name check will be clear or as uscis said if it's stuck more then 180 my case will be adjucted .
then my both I130 and 485 will approved at same time
It's mean I will get benifit under new NC policy
Thank you

Deepak,
Keep in mind every case is different but I too arrived on a B2 visa an I had my interview May 3rd 06 but was approved based on my namecheck being completed and clear. Unfortunately I got stuck there for nearly 2yrs. My I-130 was approved Oct 23rd 07 and my I-485 was approved Jan 30th 2008. I originally did my fingerprints April 26th 06 an redid them on Jan 9th 2008 even though they had originally expired July 26th 07. After constantly complaining at USCIS about my fingerprints expiring they informed me at my last infopass appointment that every office has different procedures but my office now would not resend me to redo them until the namecheck was complete an that is how I would know it was completed. Which is probably a good thing as I live 2hrs one way to my local ASC. Thank goodness for a change they were actually telling the truth even though I have learnt to take what they say with a grain of salt cause they kept changing their story numerous times. I hope this helps you a little to know that not always are the I-130/I-485 approved at the same time.
Good luck

I am confused again everybody has different words and evry local office has diffrent kind of processing for the same application.
Lets see how it's go with me
I called at Coustmer service no. on wednesday at 9 am for service request for my i-485 marriage based and the lady asked
me the key information on my case like my Name case # A # current address etc etc .
at 11:15 am i recived a call from immigration office . they asked me is your's case is based on marriage ? I said yes
then they asked me my wife name and her I-130 case # i gave them then they asked me to make sure they have my current address I gave them . then the lady told me you will be notify by mail and hang up.
What's that mean ? did they start processing my case after 2 hours of my call?

There is a woman on here whose son is waiting three years. You have been given opinions and experiences and a suggestion from an attorney. If you need someone to tell you what USCIS seems unable to tell you, you are wasting your time. We are not the USCIS. We do not hold the power to decide your case. In real life, the I-130 and I-485 are approved on the same day. It is a rare case where the approval dates are different.

As long as if the above statement right I am not worried because I know USCIS asked to their coustmer to wait till April 30th and I already called them like 4 days ago for the service request so I think I should wait because I am positive about New Memo for NC policy I am sure I will get benefit under new policy.
