in my case both I-130 and I-485 pending from last 2 years . and everytime I called USCIS they said case pending due to backgrounds checks . My case is at local office right now . when i had interview like almost 19 months ago the immigration officer gave me form I-72
It was a paper saying " CASE IS CONTINUED FOR BACKGROUNDS CHECKS AND FURTHER REVIEW OF ELIGIBILTY. YOU WILL BE NOTIFIED BY MAIL WHEN A DECISION IS MADE ON YOUR CASE."

and after few days i got another FORM I-72

Which asked me some other requested documents and it asked me include a note that you wish your originals return to you and i requested yes for it. the day i sent requested documents to uscis they return me back the orginal documents after 3 weeks. since that day i have no idea whats going on.


I called couple of time for service request and they send me same letter after 6 month saying" THE PROCESSING OF YOURS CASE HAS BEEN DELAYED A CHECK OF OUR RECORD SAYS YOURS CASE IS NOT YET READY FOR DECISION, AS REQUIRED INVESTIGATION INTO BACKGROUNDS CHECKS REMAIN OPEN , UNTIL THE BACKGROUNDS CHECK INVESTIGATION COMPLETED WE CANT MOVE FORWARD YOURS CASE"


Do you think its delayed because of FBI name checks. Am i going to get benifit under new Backgrounds checks policy?

they havent asked my yet again for the new fingerprints.

Hi:

Make an INFOPASS appointment and get a new appointment for fingerprints. If they look at your case, the FIRST thing they will do is have you get fingerprints.

I think USCIS will send me the Biomatric appoinment automatically if they need my fingerprints again thats what it saying in their letter dated Feb 20, 2008

I am wondering when other people gave their marriage based interview theri I-130 get approved same day of interview or few days after Interview even if their I-485 not approve same time but in my case I-130 and I-485 both pending from last 2 yaers . Does Local office approve I-130 and I-485 same time ?

Usually, yes. How did you enter the USA? Did you come on a K-1 (or some other visa), and then adjust status to permanent resident?

I enterd On B1/B2 visa like 2.5 years ago

Then yes, the local office should adjudicate your I-130 and I-485 together.

Yes, right after the name checks clear.

Do some searches on 'name check' or 'namecheck' and you will see there are a lot of people waiting just like you.

It looks like you also had a request for further evidence, which you supplied.

Read MrF's post again.. I'll bet your namechecks can't clear until they've got fresh fingerprints. You providing those might jump start something.

Do you have some other concern about why your case is still pending?

I know my case is pending because of Name check . As per per new USCIS memo dated Feb 4, 2008 adjuctor can approve the I-485 if it's pending more then 180 days and mine is almost 2 years .


I am only worried because the pettion my wife did for me I-130 ( who is US citizen ) is still pending and I read on many form in other case people get their I-130 approved on the day of interview or few days later.

We had intreview 19 months ago and I-130 is still pending . so that's why i was worried . I hope i will get clear in New Name check piloicy . what is yours idea?

No, it's for anyone who did the AOS process from within the USA, no matter what visa they entered on.
