I-129F visa timeline and processing question?

Default I-129F visa timeline and processing question?

I just checked the I-129F Visa Timeline on the USCIS.GOV website and
it reads that they are processing application for Oct 3, 2003. I
called the USCIS hotline and the operator informed me that I can not
initiate an inquiry till a full thirty (30) days have past from the
day my application is received, which means USCIS will initiate an
inquiry only when they are processing applications received after Oct
5, 2003.
I want to know how did USCIS skip my application, which was received
by them on Sept. 5, 2003? Does it make a difference that my wife is
from India(I am a US Citizen), so USCIS has various processing time
for different countries? Does it matter that Missouri Service Center
(St. Louis or Kansas City) is processing my application?

More info... what visa are you trying to get (K-1, etc)? What service center did you file? What are the circumstances surrounding your case (anything that may make it take longer)... etc.

You may also want to call your congressman and initiate a congressional inquery (which they will do for free). That often gets the ball rolling in tough cases and cn possibly be the only way to really find out what has happened.

Are you sure you're looking at the right thing on the site? I-129F is for the Fiance Visa but you're married and should be going through the K3.

Don't you think is time to contact your rep??,
What state are you from?.
Go to: http://www.congress.org/
Click US Congress and follow the path to your state's congressional members. Choose one and you will see if they have a website. If they do, their website will provide the form. If they don't have a website, you can usually e-mail them thru the Congress.org site and/or call their office on the phone and request the form to be sent to you.

Yes he looked at the right aging report, MSC is currently working on applications received on October 3rd

The I-129f is also used to petition for a K3 visa.

You should be careful to distinguish between the different stage of the immigration process and not use terms for visas (such as K1 and K3) when talking about petitions. Such incorrect usage creates confusion.

And as this thread shows, it is sometimes necessary to specify both the petition and the visa - by their correct names - to avoid confusion.

I have a K-3 Visa pending. I should have clarified that in the intial
statement. I am Chicago, IL, so I am going to call Senator and Rep.
too on Friday. Thanks a lot.

I e-mailed the Congressman and Senator from Chicago on Dec. 26, 2003
as per the suggestion of this News Group but I have not heard anything
from either of them, do their respective office reps contact you? How
long should I wait till I contact the offices of the Congressman and
the Senator?

My K3 was received on 9/2 per the receipt, website said 9/3. I received my
approval on 11/25.

As you probably already know the MSC appear to almost completely stop
processing K3's for 2 months
almost exactly when we sent in our I-129f's. This I found out through my
senator's office was due to additional
work that the MSC took on from the local offices. I contacted my senator's
office early in the process due to
our home in Jamaica getting broken into twice. The second time my wife was
cut and had to have a few
stitches.

When I emailed the senator's office about this, and that I believe the break
ins were due to it being widely known she is married to a USC, since I lived
there with her for quite some time. In Jamaica a USC means $$$ whether true
or not. I honestly don't know the the senator had any results in speeding up
my case. I sent the email out first thing in the morning and received a
phone call from his office by lunchtime. He's got my vote next time around.

Fortunately there have been no more break ins. My wife's interview is
Thursday.

One thing that may help, I honestly don't know, but I did it in my email. I
used as many phrases/keywords as I could to try to get past any email
processing software that the office may be using. Like US citizen needing
help overseas. It may have had no effect, but I did get a quick response.

I hope things get resolved for you quickly.

Well, I just checked the USCIS website and they are processing I-129F
K-3(spousal visa) for Oct 17, 2003 which is 1.5 months past my
application submission date. I do not know why the Missouri Office is
taking so long to process my application.I also have been contacted by
my congress person's office on Jan 5, 2004 and received a letter from
them that they have contacted the MSC office in regards to this
matter. Do you think I should also contact the USCIS office and
intiate an inquiry or will this further delay my case.
Any help will be greatly appreciated

No don't do that because that is who initially your Congressional Inquiry will start from (chain of command). Let the inquiry do it's mission first. I know it's hard, but try to be patient a bit longer.

You are mis-understanding what the CIS means when it says that it is processing petitions or applications from a specified date.

In the case of the NBC, they are saying that petitions prior to 10/17, and some from 10/17, have been taken off the shelf and have been given to an officer to review. That officer now has his own stack of cases to review, and he isn't doing them all at once. A few may be open on his desk, some will be at the top of his in-basket, others will be at the bottom and may not be seen for days or weeks yet.

Further, in the course of reviewing the petitions, the name of the beneficiary will be checked against names on 'watch lists' using a system called IBIS. If a match is made, that case will be put aside while further investigation is done to confirm or deny that the beneficiary of the petition is the same person as is on the watch list. This can add significant time to the review process.

Your petition is now more than a month overdue, so you should make an inquiry. However, recognize that there may be valid reasons why your particular petition is taking longer than others.

Actually they are further along than 10/17. We are 10/27 and were approved on 01/06. A bit of a mystery why more people before us were not approved - are they just on someone else's desk? Did we happen to get someone who works quickly or had more straightforward cases? One never knows.

Well, I think the congressman's inquiry may have worked because when I
checked my case status on-line today. There was a request for
additional information, so I called the BCIS hotline but the lady
could not tell me anything except to wait for the letter to arrive.

So I went and did a search for "Request for additonal information" on
this newsgroup and found out what my RFE probably will be for? Long
story short, I had forgot to put down my spouse's Date of Birth, and
had written "NA" where I should have written "none" in a few places.

As soon as I found out about my mistakes, I was so furious at myself
that I had step away for a few hours. I am still angry at myself and
wondering how I am going to explain to my wife and my parents about
these delays. Hindsight is 20/20 and I am feeling like a Monday
Morning Quarterback-->"I SHOULD HAVE HIRED A LAWYER".

So here is my timeline:
1st NOA Sept 5, 2003 from MSC
RFE Per website Jan. 13, 2004(still waiting for the letter)

I also checked my I-130 application and found out that I had made some
of the same mistakes listed above. My question is that "Should I send
a letter to
the Lincoln, NE center about my mistakes or wait till I get a RFE from
them?". A second question is that "Will my I-129F(K3 Visa)application
be kicked back to the end of the line because of a RFE?". and last
question "In theory how long does it take after an RFE is received to
process an application?
