I-129 app. approval and a question
Hi Folks,
Finally got approval from NSC on my I-129F application. Wow!
Timeline:
1st NOA - May 3 2002
RFE - Sept 13th 2002
2nd NOA - Oct 18 2002
Thanks to everyone who encouraged me after the RFE. Your kind words
really helped.
Now, just one question I hope someone can answer.
Does the I-134 affidavit expire ?
I sent one to her some months ago, thinking this would
all move along a bit faster. Now I'm worried that the I-134 might be
rejected for being too old. On the WEB I found that the I-864 is good
for 6 months after the signature but can't find anything about the I-134.
Can anyone help ?
Thanks!

CONGRATULATIONS to another NSC escapee. Hope your future process goes much quicker and smoother.
To your question....it depends on the consulate. Some look at them and others don't. Just to be safe, I would provide a current I-134 for the interview.

it could take another 100 days to make a decision after they got the
addtional evidence, it didn't take that long. The full timeline should be:
May 3rd 1st NOA
Sept 13th RFE (They wanted more proof I've been divorced since 1986)
Sept 26th INS confirms additional evidence connects to the case file
Oct 11th File goes back on agents desk
Oct 18th 2nd NOA Application approved
Hope that helps

Hi LSJ,
I am waiting for divorce papers before my fiance can file the I-129F. I am wondering exactly what proof other than the divorce decree the INS want? I was hoping that would be enough.

Debbie,
I am also waiting for the final Divorce decree of my future husband. I was under the impressiont that this was all we needed to prove his divorce.
That is all I have to prove my divorce, I am the USC and that is the only document I have.

My wife submitted her original divorce decree when we filed for me as a fiance, the INS (TSC) accepted it with no problems.

If you are not self-employed and used an employer letter and paystub to substantiate your income for the purposes of the I-134, then just send her the latest paystub to prove you are still employed with the same firm.
If you also included bank information (some people include everything on the list of one or the other) then also send her the last bank statment sent you or if you don't get a bank statement in the mail, print out the current statement from online and send that to her.

Re: I-129 app. approval and a question
We send the full divorce decrees from Jim's two prior marriages and my one prior marriage and there was no problem. Just be sure that you copy all the pages of the decree and that all markings rendered by the court and the filing office are clearly visible.

decree. For some reason that still remains a mystery, this Decree is
only signed by one of the parties. In the offical court archives the decree
is attached to the 13 page settlement agreement, which IS signed by
both parties. The INS did an RFE based (I think) on the decree not looking
complete. I sent them the whole wad in response to the RFE and 3 weeks
later, approval. Hooray!
Also thanks for the advise concerning the affidavit.
