HI,
I hate to be a pest, but how long is it (in general) for the Fiancee visa to go through, and they are allowed into the US?
If the non-USC has a child, who will be coming with them, will that complicate matters?

There is no clear cut answer to your question about the time frame. You have not provided enough information about your location and your fiancee's location.
Also the child's non immigrant parent can cause big problems...assuming he is alive and does not wish the child to leave his country.

YOUR NOT A PEST. MY HUSBAND AND i HAVE THE SAME PROBLEM. I HAD ONE OF MY SON'S IN MOROCCO AND ONE OF MY BOYS HERE IN THE US. MY HUSBAND AND I GOT DIVOICED BECAUSE WE THOUGHT THAT IT WOULD BE EASIER TO GET HIM HERE. WHEN WE REALIZED HOW CRAZY THAT WAS WE REMARRIED AND FILED A K/3 VISA FOR HIM NOW BECAUSE MY SON WAS BORN THERE IN MOROCCO HE WILL BE COMING OVER HERE ON MY HUSBAND'S VISA K/4. BY THE WAY I AM A US CITIZEN. WE HAD OUR INTERVIEW ON FEB 9, 2004 AND HE STILL HAVEN'T RECEIVED HIS VISA YET BECAUSE OF SERCURITY CHECKS. I APPLIED FOR THE I-130 IN EARLY SEPTEMBER AND FOR K/3 VISA MID SEPT.2003 I HOPE THAT THIS HELPS A LITTLE.

NO BECAUSE IN MOROCCO THEY GO BYE THE FATHER OF THE CHILD AND ALSO HE HAS BEEN THEIR MOST OF HIS LIFE. MY OTHER SON HAS TRAVEL TO THE STATES EVERY YEAR OF HIS LIFE . I DON'T KNOW THE DIFFERENCE BUT THAT 'S JUST THE WAY IT IS.

Mrtravelkay's comment is in the form of a question. You Morccon born son may very well have dual nationality -- however, we don't have the details on YOUR life sufficient to determine if there is derviative US citizenship for your son.

The fact that Morocco uses the father's nationality
would not change US nationality law. It's very possible
that your son may also be a US citizen whether he acknowledges
it or not, and whether Morocco allows it or not. Current US
law says that a child born outside the US, to one US citizen
married to a non-US citizen, will automatically be a US citizen
if at anytime prior to the birth, the US citizen parent has
been physically present in the US for periods totalling at
least five years with two years after age fourteen.
So, if the mother has already met those physical presence
requirements, then her son would be a US citizen. She hasn't
included enough information to determine this.
