How long do I wait before contacting the INS ??

Default How long do I wait before contacting the INS ??

Hello All,

Hope this message finds you all in good sprits and yer all hanging in
there.

Its been nearly 5 weeks since myself and my wife have sent our
petition to the Ins in Jacksonville and we have not heard anything
back from them. Is that good or bad news as regards the INS finding
Mistakes with our petition or them Rejecting it can anyone tell me.

Also I was wondering how long will I wait before Contacting the INS
with regards our petition? Were seriously in need of something to
happen , Like get my ECAD because my wife will give birth to our son
in less then 7 weeks now and she will be giving up work soon and we
will have no income , that thought is disturbing as you can Imagine.

Would I be right in saying that If I do not here from the INS within
90days of them receiving our petition (We have a receipt from the post
office stating that the INS received our petition and the name of the
person who signed for it , time and date.) I can request a Temporary
ECAD until things get sorted out.


A bit of background information. I came to Pensacola Florida on a Visa
waiver and we got married here in Florida and sent paperwork off to
the INS in Jacksonville to apply for a Green Card through marriage to
a US Citizen while here in the US.

Hi Mick,

Don't you just hate waiting?? My husband and I are in the same type boat. Married on a VW whilst he was in the USA on holiday. We filed all his paperwork 12 weeks ago and haven't heard a whisper since. One good thing is that our local INS office issues EAD's on the same day (while you wait). Unfortunately, the EAD is practically useless without a social security number. We've been waiting for almost 12 weeks for that as well, and nothing.

So...in my experience...five weeks may not be enough time. By that I mean, whatever they tell you the processing time *may* be...triple or quadruple it. I'm not saying that's the Gospel truth, but as a general rule, I don't think much happens when it is supposed to. Keep in mind that once you get the EAD, you will still need to wait for the social security number!

Slightly off topic...I am pregnant too, but not due until July. Since my husband cannot work, we're worried about bills and whatnot. When your wife goes off work for maternity leave - won't she get any short term disability pay? Even if it was only six weeks or so...it would help. A lot of companies have that option. Even though, under FMLA guidelines, I am eligible to take three months (unpaid) I can only afford to take what my company offers as paid time. I wish I could spend longer with our baby, but, it won't be possible. Anyway, I hope her matenity leave will cover at least a few weeks.

Oh yes, I would like to add as a disclaimer that I have heard/been told that apparently it is possible to find someone to hire you whilst your SSN is pending if you have an EAD.

Although this very well may be true, I have yet to find any employer in our parts that will do so. My husband has been told on more than one occasion that he has been hired, only to be put "on hold" until his number is available. He's had to let a few perfectly good jobs go because he couldn't produce his SSN.

Maybe others have had or will have better luck!!

I was thinking the same thing, beyness, after we got Philip's work authorization card we visited the social security office the next day.

Philip was already in their database as having valid work authorization and his card was in our mailbox within a week!

Why are some people getting their social security #s in 2 weeks, while others say it takes ages. Did youo go into your social security office and ask what the deal is? This is vey strange...
Good question...I wish I knew what the discrepancy is. Why is it a few weeks for some and a few months for others? A friend of ours from Africa received his SSN after a mere 3 week wait, which just about put my husband through the roof.

I have corresponded with a nice gentleman from our local SSA office and he tells me that as far as SSA is concerned, they are just waiting on the G-845 (Verification Request) back from the INS. The entire hold up is on the INS (of course). We've been advised to go down to the INS office and question them.

I've been hesitant to do that for the same reasons most people don't enjoy visiting down there. It is (literally) an 8 hour day spent waiting and I witnessed a dozen situations last time we were there where a person had stood in line for the better part of an entire DAY...only to get to the counter and be told abruptly, "We can't help you...NEXT!"

As I am pregnant, my vacation time is very valuable to me and I don't relish wasting a day down at INS just for them to blow me off and leave me with more questions than I started with. However, for the sake of my husband's sanity and the pile of bills that are starting to accumulate...we're going to have to take a trip down there. :O

I agree Beyness...it's a weird situation.

It seems that maybe Dave and I are in an unusual predicament. I guess I thought the twelve week wait was somewhat standard, but from what you and Beyness have said, it is not the norm.

Hmmm...

I suppose someone is using our paperwork to wipe up coffee stains or something.

Thanks for the input...that trip to INS is going to have to happen.

When I went in to apply for a new Social Security card after my marriage I was told that it would probably only take a few weeks. I waited, and waited and waited........Turns out that they had lost my application. Now mind you I was 48 years old at the time and had had a social security card since I was 13. So this was not getting a "new number", just a new card for the old number. I got in touch with a very nice lady at the office who gave me an appointment (normally done on a walk in basis) and told me to come in and she would personally handle my reapplication. I went in, she then sent me a letter that said to let her know if I didn't receive the new card shortly. Very professional behavior on her part, I think they ought to promote her to the head of the INS!!!!!!

I am starting to think we have been "lost in the cracks too"...that would be exactly my luck! Maybe we will find out more when I visit the dreaded INS office. YUCK!

The INS does not, NOT, issue social security numbers; that
administrative task is bequeathed to the Social Security
Administration.

Cindy didn't say that INS did issue SS cards. She said that the professionalism of the lady at the SSA office should be promoted to work in the INS and then perhaps the INS would handle things in a professional manner. She was inferring that INS doesn't.

Have your checks been cashed yet? It doesn't have to do anything with rejection or mistakes if you haven't heard so from INS. It took the INS 4 months to open the petition of one of my friends in the Detroit INS office. It took them ~1 month to open mine. Once the checks are cashed however, you expect to hear from them via a receipt.

If your checks have been cashed a "long time" ago, you can go to the office, and ask about your petition as you have not received a receipt from them yet.

I think that the 90 days start from the date of the receipt or when your checks have been cashed, that is when the INS had your petition in their hands as opposed to in their mailroom.

Now, maybe if you go down there anyway and explain the situation, maybe you will have somebody understanding... but do not count on that!

If nothing has happened no checks cashed, no receipt, you can also ask your wife to contact her congressperson and have them investigate what is going on. If she explains your situation, they might try to get you an EAD ASAP.

Hey All,

Thank you for you help , We Used Money Orders is there anyway to find
out if they have been cashed ? , we used Pen Air Bank to get the money
orders. We live in Pensacola Fl and our INS Office which is looking
after our case is in Jacksonville , Which is about a 5 or 6 hour drive
away so Its just not a matter of Popping in to see what has happened.
And I don't want to drag my heavily pregnant wife (nearly 8 months)
all the way down there just yet. If It was a case of having to go down
to Jacksonville INS office , would my wife have to be with me ?

How dose one go about contacting their congressperson for their area
can anyone Tell me.
