No.. We have seen this, recall the kid's father who came to pick him up.
Believe it or not, not all Cubans want to migrate to the US.
In answer to the passport/visa issue. Unless they are planning making an
illegal trip, then they need a visa and passport. No one said they were
easy to get, just that they are needed. You asked how to get your
"girlfriend" here. You didn't say spouse or fiance. For all we know, you
want her here on a student visa.

Ok. Let's try this one.

Options

1. Tourist Visa
2. Student Visa
3. Spouse Visa
4. Fiance Visa
5. Employment Visa
6. Talent Vias

If #4, have you seen her at some point in the past 2 years?
If yes, did you travel to Cuba legally or did she travel to the US legally.
Ok I would want to get her here on a fiance visa....she has never been in the US but i have been to cuba 3 times Illegally thru Mexico

Are you prepared to admit to the US government that you met her while
illegally in Cuba? See an attorney.

Are you not worried that when you submit evidence of your meeting in Cuba, that you will be discovered as to having travelled illegally?

Something that always looked weird, why the downer on Cuba, Bay of Pigs a long long time ago, do not do the same thing to Vietnam?

Anyway is this a slapped wrist situation or are ther really negatives about having gone?

In an effort to better understand this let me ask a question... is it illegal to travel between Mexico and Cuba? If it isn't illegal, then I'm guessing that as long as you legally entered Mexico, the trip to Cuba was legal. Or am I off base here and just don't realize that it's illegal for any USC to travel to Cuba no matter how they get there? Enquiring minds want to know!

ENTRY REQUIREMENTS/TRAVEL TRANSACTION LIMITATIONS: The Cuban Assets Control Regulations of the U.S. Treasury Department require that persons subject to U.S. jurisdiction be licensed to engage in any transaction related to travel to, from, and within Cuba. Transactions related to tourist travel are not licensable. This restriction includes tourist travel to Cuba from or through a third country such as Mexico or Canada. U.S. law enforcement authorities have increased enforcement of these regulations at U.S. airports and pre-clearance facilities in third countries. Travelers who fail to comply with Department of Treasury regulations will face civil penalties and criminal prosecution upon return to the United States.

As I understand it, Cuba is a special case -- if caught by immigration
or the coast guard before getting into the country, they will be
deported, but once here, they are accepted.

Of course, that's neither a visa, nor marriage based...contact one of
the cuban help groups in miami would be my suggestion.

You're off base. It's the opposite of the situation for Cubans -- they
aren't "allowed" to come here without the proper documentation, but
unlike everyone else IF they get her without the proper documentation,
they are welcomed with open arms. While for a USC, going to Cuba is a
crime, unless you have explicit permission from the US government.

Cuba requires neither a passport nor a visa, so it's not hard to break
this law and not get caught, but I'd be hesitant to write it down and
sign an immigration form saying that I'd broke it.

As I see it, he has three choices: take a chance on jail and pursue a
fiance visa with his visit to her, arrange to meet in another country
(fly her to Mexico for example) and pursue a fiance visa based upon
that encounter, try to arrange to smuggle her into the country
(probably via either Canada or Mexico) where she can then legally
adjust status.

I'm not advocating any of the above options, so am not part of any
conspiracy to break the law....

The irony in all of this is that the USCIS director, Eduardo Aguirre, immigrated to the US from Cuba.

Here's the relevant part:

"He and his wife, Maria Teresa, each emigrated from Cuba as unaccompanied minors at the age of 15. They maintain their permanent home in Houston, where they have lived for nearly 30 years, and presently reside in Washington, D.C. The Aguirre’s have two grown children, Eddy and Tessie."

Yes, and notice that the restriction isn't just for US Citizens, but
for all "persons subject to U.S. jurisdiction". This includes green
card holders. Not that it matters for the case we were discussing,
but if others of you are thinking about a vacation in Cuba... For
the case we were discussing, it would be worth finding out whether
her exit from Cuba would have to be permanent. Would she be allowed
to go home and visit relatives and return to the US? I don't know
the answer, but it sounds like it's worth finding out before proceeding
too far down the visa journey.

A further problem, as I understand it, is that Cuban citizens must
get an "exit visa" from the Cuban government in order to leave Cuba
legally. I know virtually nothing about Cuban exit visas except
that I hear they can be hard to get.

Do a fiance visa should take around a year.
The gov't won't ask you anything.
I have quite a few friends who have brought their fiances from Cuba.
You can also go to Cuba with some sort of a group like a dancing group.
It's a lot of work, but it works like a charm every time.
