You are in the US illegally....you have been working illegally...you have not been paying income tax on your earnings. I would say you have quite a lot to be worried about...but you seem to have faith in your attorney...I hope he can deliver.

There are very real risks of refusal and removal from the US with a long term ban on reentry. There no point in pretending otherwise.

50/50 with respect to US immigration.

However, your biggest worry probably isn't US immigration... but the IRS.

The IRS doesn't care about that. If you have any income at all, you are obligated to file a US tax return if your income is over the filing threshold. The filing threshold is pretty low... details at www.irs.gov.

I believe there was a person in the "Marriage Based Forum" recently that was in a similar position being in the US for about 8 years and adjusting status. He was sweating golf balls when he went to the interview but they didn't even ask about his overstay. Some people are lucky and others aren't.

Look through the "Marriage Based Forum" and see if you can find his post within about the last month.

Good Luck

BTW, I'm American and that is why I am gentle.

I'm sure stuff happened. Stuff always happens... but you chose to stay. Now it's time to face the consequences of that decision. You might get lucky... you might not.

I'm closing this thread, as there is a duplicate one running, with more precise information.
