Help question about I-130?
Me and my girlfriend have gotten married on her visit to kentucky, she
is from Canada by the way.We know she can visit me from time to time and
not have much trouble as long as she proves she is working and has bills
and such in canada.....My question is this.....? She goes back to canada
this coming sunday, and id like to know if i file the I-130 Form next
week how long does it usually take to process? and also while it is
being processed can she visit me again for vacation while its being
processed as long as she can prove she has no intentions on staying
until after the 1-130 has been approved.? Please Help..

Wow. That's kind of scary how similar your situation is to me. I'm Canadian,
and married my husband on a visit to Indiana a little over half a month ago
now. We filed the I-130 on the 31st of October and haven't received NOA1
yet, but hopefully soon. It's only been about a week, I've gotta be patient!
But yeah, I'm in the same boat wondering how long the whole process should
take, going the K3 route. Also, we just have to wait until receiving the NOA
to file the K3, correct?

Re: Help question about I-130?
Wretchedmidget,
You ask some interesting questions.
Unfortunately, there is a vast difference between how long it SHOULD take and how long it DOES take.
Yes, once you receive I-130 NoA1, you can file your I-129F. You can expect to wait 8-12 weeks for I-129F NoA1 and NoA2, depending upon conditions at the NBC, which are impossible to predict. Then another 6-12 weeks from the time the package is approved by the NBC until interview, with lots of other milestones along the way. The wait time after the package arrives at the consulate in Canada is typically shorter than elsewhere. All of this is assuming that there are no complications. Your mileage may vary. I suggest that you read the FAQ and other collected info at the top of this forum. Additionally, read a week's worth of posts to this forum. You'll have answers you have yet to think of questions for, at your fingertips. I'm no expert, I've only been through this once, and believe me when I tell you, once is enough for me.
All the best of everything to you.

Re: Help question about I-130?
I'm UK and I married my USC husband in America in July 2003. We have filed an I130 and I129 .
The I129 process should take around 4mnths, although there are no guarantees.
I returned to the UK after our wedding. I am at present in the US, visiting while my application is being processed.
I posted my experience here:

Good Luck

Re: Help question about I-130?
David,
My experience is similar to CB, except I cannot say for sure when my NOA2
will be received (it's over 80 days so far from NOA1)
My wife and I got married in Massachusetts in July. She returned to
Argentina to wait for her K3 visa and take care of lots of personal matters.
We have met twice since then, once in Argentina and once here (she just
returned).
I got a lot of help by following on this site:
http://www.mediabrew.com/k3/list.php. I suggest you add yourself here too as
soon as you file.
Based on the dates on that site it should take overall 3-5 months from
filing of I-129F to getting the visa at the consulate.
But as other members said, there is a huge variation.
In my experience and my understanding there is no reason for your wife not
to visit here.
Wish you good luck, and congratulations on your marriage!.
