HELP! Marriage laws in Argentina
I'm gathering information to do a direct consular filing at the consulate in Buenos Aires Argentina with my fiancée for the I-130 (We want to get married and bring her in as a "relative") but I just found out that the law in Argentina requires 28 days prior notice to the civil registry before the marriage certificate can be handed out and a medical exam for me 7 days prior as well. I can't take off all these days from work, does anyone have any experience with this? Will they accept medical statements from a doctor in the States or will is there any way to be examined that same day? It's getting down to the wire and I'm at a loss for what I should do.. we may have to continue with the K1 route but we really wanted to apply for the I-130 and get married as soon as possible.
The prospective wedding date (on paper) is her birthday, November 25th and I'm trying for an appointment in Buenos Aires for December 2nd.
Any help at all would be appreciated, especially someone who's dealt with the Argentine civil registry.
Josh.

Re: HELP! Marriage laws in Argentina
JOSH,
The following is speculation based on having looked at the laws here (England)
when my fiancé and I were deciding. I was wondering if it's possible any of
this might work for you. You would have to check.
Here, the waiting requirement is shorter - I vaguely remember something about
15 days but can't be sure. But it still needs fulfilling, according to what the
registrar told me about marrying an alien. When I told her the problems about
Garth getting time off work she said it was perfectly legal for him to come
here and register the marriage with me, fly home and work, then come back and
marry me. (Please, anyone doing this in England check with a registrar because
this info is old and vague in my memory. But it went something along those
lines.)
Anyway, I was wondering if you needed to be in Argentina for the whole
registration period. Or whether you could fly in, register, fly out and then
back at the end of the month? This option was beyond our finances - I don't
know how you're fixed in that way. But if it's an option it would be worth
asking that specific question of an official as I notice your post talks about
'prior notice' rather than 'residency'.
Also, are you sure you need to be there to register the marriage? You do in
England, but it's worth checking. There's a slim chance you could forward your
ID documents and your fiancé could do the registering. Very slim but everything
is worth checking.
Finally, I found out the loopholes (though I don't remember the exact details
now) by talking to the registrar direct and explaining our problem. She was
very sympathetic and responded by saying what other people had done. If you
haven't already spoken to a person like a registrar but just looked up the law
I think it would be worth doing.
In the end my fiancé and I decided it would be much simpler and cheaper to
marry in the States. But I wanted to let you know some of the things we
investigated in case they might help.
Wishing you all the best.

Re: HELP! Marriage laws in Argentina
My understanding is that what you have describe is accurate, that is why we opted for the I-129F K-1 visa. If you bring her as your wife it would not be a K-1, I believe it would be a K-3 and it takes longer to process. The situation with the Argentine registry is accurate. You can't just catch a plane get married and file, and fly back. Trust me, we tried. Although they say DCF is faster, just taking time off from work is a hassle (I have the same problem) so my fiance who is in Buenos Aires has written to the consulate in Buenos Aires and received the information he needs to set this thing up. Our idea is to be married by Feb 6, then we will return to Buenos Aires sometime next year and be married over there as well, just as a formality for his family.
Good luck .

I just found out that the law in Argentina requires 28 days prior notice to the civil registry before the marriage certificate can be handed out and a medical exam for me 7 days prior as well. I can't take off all these days from work, does anyone have any experience with this? Will they accept medical statements from a doctor in the States or will is there any way to be examined that same day?
In France, we have a similar requirement for getting married [papers must be filed 2 months in advance, medical exam is required and one of the future spouse must have resided in the city where the marriage takes place for at least 30 days, then banns are published for 10 days. So, there is a 40 days requirement]. However, only one of the future spouses needs to file and needs to be in the city where you will get married for those 40 days. The other can just show up for the wedding day. The medical (in France) is not an INS medical, it is just a general physical exam and can be done by pretty much anybody.
I know that this doesn't help you much since you want to get married in Argentina, but maybe you can find out with the Argentinian consulate if the law might be similar in Argentina.
