HELP! AOS Interview questions
We just received notice that our AOS interview is scheduled next week
(After just over a year from filing, Yea!)...
On the downside, it says we are supposed to bring letters of employment...
That's going to be impossible because I was just laid off from my job
(Thanks WorldCom!)
and have just started to recieve unemployment and my wife quit her part time
job
last month to be a 'nanny' for some friends of ours and is now just being
paid cash.
I already made way over the minimun poverty guidelines for the year (if that
helps).
We have put our house up for sale and we are planning to move to Idaho and
stay
with family for awhile. Once the house sells we will be debt free with about
80K in
our pocket.
Is this going to cause us problems? I've always heard that as long as the
marriage
is legit there is nothing to worry about.
Any thoughts, opinions or advice out there?????

As long as a marriage is legit and you can prove it, yes, that takes care of one of the main issues of AOS. However, the second issue is financial sponsorship. You don't say who is the foreign spouse and who is the USC in your equation but assume you are the USC. Since you filed over a year ago, bring the last IRS tax return and W-2's that go with it to your interview. Calculate what you are "earning" from Unemployment Insurance and bring your booklet or whatever paperwork comes with UI payments to back up your claim of still meeting the financial guidelines of 125% of the poverty level.
As for your wife working off the books, somethings are better left unsaid.

Unfortunately I'm unable to answer your question but whereabouts are
you going to be in Idaho? I'm there myself. I used to laugh at the
statement of "do people actually live in Idaho"?
