Default Has anyone ever done a FOIA on their immigration case?

I am specifically thinking of Michelle and Herb here....once they are
approved, it would be *quite* interesting to see _why_ BCIS (or
whatever they are calling themselves nowadays) felt their was fraud in
their case.

Attorneys on this board----have you ever heard of it being done?

Yes, but you might not find everything you want in the FOIA reply. Plus they can and do black out parts they don't want you to see.

I've done a FOIA on my wife's case with DHS, we got about 200 pages of documentation, I also did a PA (Privacy Act) case on me and got about 20 pages re: my citizenship. In both cases the did not submit all documentation, we've appealed. Also, we did FOIA/PA requests to the State Department, still pending. Such requests are useful if only to get [some/most] of the immigration history in the file, but, as Matt pointed out, some stuff will be edited out, still, woth a go!

Practice tip: Do NOT, repeat NOT ever direct a "FOIA" request to the Department of State. State takes the STRONG and UNWAVERING position that 222(f) of the INA trumps FOIA. Invoking FOIA or PA quarantees you will get NADA mas nunca.

FIOAs have been done before. They don't always tell you why the BCIS
thinks it's fraud though.

Hi:

I saw a FOIA response the other day on a consultation. Sad case where couple is long married and neither the court nor the BCIS has jurisidiction over an AOS -- [it hurts to be an "arriving alien"].

There was an I-864 in the file with the supporting tax returns. They left in the wife's name but blanked out her address, social security number, and the $$ figures on the tax returns! Oh, yeah and also blanked out the employment and pay information from the I-864.

Clare thinks Hyper is being very bratty by keeping all of the n's with the curly accent thingies over them for herself

Actually, there are language functions in Windows [and before that in DOS] for your keyboards. My puter is US English -- so I don't have the "ny" character. [Yes, I know that you can do it by an alt-key, but I'm to lazy to look it up!].

That reminds me of the time I arrived in Cancun for a vacation.....the
Mexican immigration agent asked me if I spoke Spanish, I said yes, then
he said for me to say a few words.

I responded with "Tecate" and "cervenza"----he laughed and stamped my
passport!
