Got EAD Renewal! - thx Rete/Ingo/Others (long)

Default Got EAD Renewal! - thx Rete/Ingo/Others (long)

I finally got EAD, here is the story line.

7:30am
arrived at INS Chicago the person in front was different from the one
who had not let me in last time, I told him I wanted an interim EAD,
and had applied for I-765 and had waited 100 days and past the 90 days.
He said it is 90 business days. I told him I had a paper from BCIS (Sec
274a.13 Application for Employment Authorization) and it is 90 days, he
let we in the line of walk-ins.

Waited about 15 minutes in line and finally they let us go upstairs
into another line, there were around 40 people already in line who
probably got there even before (they open the door at 7am). The EAD
waiting area was 20% full and the other waiting area was 80% full
(other place for AOS, K1's etc).

I saw two ladies at the form desks, one was the one who had rejected me
before at the door 1 month ago, while another one was to her right and
was much nicer looking. It looked as if I am going to the same lady the
way people left the lines to talk to each ladies, though for some reason
the nicer lady finished faster and my wife an I got to her. She said that
I should come back in 90 days from the date check got cashed, again I
mentioned the piece of paper I had and showed it to her. She was rather
surprised and told me: "wow you have done your homework", and was very
amazed, asked me couple of time where I had found it, and I told her. I
also told her that is what the law states and it is 90 days from the day
they receive the letter and showed her the delivery confirmation stub +
paper from usps.gov showing when INS received my form. She was very
thankful, told me that she had learned something new, and told me that
"they" had told her to tell people,date of cashed check + 90 days, though
she let me in, gave me a form to complete and stapled the canceled check
receipt, original copy of from Money order, delivery confirmation stub
+ copy of usps.gov. I filled the form and stated again on the
comment-line that I was entitled to the interim EAD based on wait of
    > 90 days and referred back to the law.

I waited in the waiting area for 4 hours, eventually I was called and
signed the piece of paper and got the FULL EAD! not interim... I asked
and they told me that they were giving me the full one, also I got a
receipt for $120 dollars which looked as if it came from my receipt
letter they had never sent me the receipt was dated 12/19/02, so they
probably did not send me the receipt or forgot to do so.. there were some
people who got that far like I did but were returned because they could
not prove INS had received the paperwork, or they did not have the
cancelled check, but I had gone in a battle armed with everything I
could have on my possession.

So the moral of the story as a postmortem to Everyone!

- Send the renewal well in advance, send it 6 months in advance!
- Bring the Sec. 274a.13 print out if you have waited past 90 days!
- Be assertive, defend your case. Don't be shy!
- Bring your spouse who is USC with you. It could help!
- Bring everything!, AOS letter, copy of the check sent or second stub,
canceled receipt, return receipt from postal services, or delivery
confirmation + usps.gov tracking/receipt info. Bring Everything!
- Have faith!

I want to thank Ingo/Rete and others who have helped me tremendously, I
want to contribute by setting up a site dedicated to EAD, let me know if
this is something that could be useful, or just add my comments and
others and links to IRS into a site that can be pointed to for every EAD
question. Because it took me many readings in this NG + other sites to
get where I am with the knowledge of all of this, I think we should
spread the word, because some INS employees are not very knowledgeable
or the ones that are do not want to give things to you at ease for some
reason.
There are though some very nice INS agents like the one I saw today, I
wish her good and I wished I could go thank her though she was rather
busy when I was done with my EAD. Basically like the saying, one bad
apple does not spoil the whole bunch, though reading on horror stories,
most of the time it seems as it does

A great read and wonderful to hear that you were able to stand your ground and not only get what you were entitled to but to educate an employee of an agency on their own regulations.

As for a thank you to the nice lady, if you remember her name, write a letter of thanks to the head of the Chicago BCIS office and send a copy to her attention. A nice way to plump up her employment file.

Ccongratulations and thanks, I am printing and saving this for when that time comes for my husband. One thing in your excellent recount bothered me, the lady remarking that you had done your homework. Obviously one of two things, either she was giving the standard 90 biz days as an answer or 90 days from the date of cashing check, either way incorrect. She didn't stand her ground with whichever incorrect answer she had which leads me to believe that at least some employees do know better, but simply give the answer they are told to give or give the one they think that the average Joe will swallow.........Knowledge is power!

Overall I am happy it is over (for now) though the whole
experience scares me a bit, for myself and others. I assumed
that the customer is always right (i.e you pay for the forms, file,
etc). But today I saw that this is not the case.

The weird thing is that the yellow receipt (grocery style) I was
given had some marks of staples in it, as if it was taken out of
the receipt paper they are supposed to send me once they get
my application, though for some reason they had never sent it,
until I showed up. I assume many many people's receipts are
still at the INS, while people check their mailboxes daily for
either a receipt paper or appointment letter.

But the bright side (that little light you can see once in a while
at the end of tunnel), you have rights, use the 90 day law at
will, and they shall not do anything than abide by that rules.

so is it REALLY 90 days and not 90 business days. I got receipt from
Dallas INS office and its dated 12/3/02
So I am pass the 90 days but not 90 business days. My receipt says not
to inquire until 4 months passed but I *REALLY* need that EAD. If the
law really says its 90 days I will take that printout and go try it
tommorow

I believe what they told you (4 months - 90 biz) is the time it takes
them to give you the full EAD.

If you do not get your full EAD by the 90 reg. days, you're entitled
to an Interim EAD. So I'd have to say yes. They should give you
an interim based on the law.

Are you working currently ? or seeking employement ?

Yes, well yes 4 months time is most likely the time for full EAD. But
if there is chance to get it earlier I sure don't want to wait another
month. Because of some problems I've been waiting for over a
half-a-year now without job.
I overstayed my tourist visa and since I got married last July and
moved to Dallas with my wife I had been home not working. My wife has
to make enough money for both of us and it's getting really hard.

You might want to seek advice from others, I am not
too familiar about people overstaying their visa, etc. who
have just applied AOS and wait for EAD. Though in theory
you should be able to get the interim after 90 days wait time.

I am afraid if you overstayed your visa longer than usual, it
could affect your AOS/EAD process, though I am not a pro
at it and can't say much about it.

Since he got married to US citizen, the overstay is likely not going to be
a problem. However, it might be a problem if he needs to leave the US (so
check back here before applying for Advance Parole!) But as long as he
stays in the country, no problem.

So I went to INS today. Unfortunately (but not surprisingly) it didn't
turn out exactly how I planned. I was waiting in line since 4am until
7am. When I FINALLY got to the little window I told the lady I'd like
to get interim EAD sice I've been waiting over 90 days. Guess what did
she say ? We're sorry, but we're closing earlier today because of some
stupid construction, so you have to come back on tuesday...I couldn't
believe it. Weird thing was that everyone else got their number and
went in so why not me ? Anyway she handed me the I-765 form. I asked
her if they will REALLY give me my EAD if I come back on tuesday, she
said "if you've been waiting over 90 days". I said I did, so she said
yes. Well I wonder...
Anyway do I have to fill that form again ? What do I put in line 11 ?
Have you ever before applied for EAD and with what results ? It was
neither approved nor denied, I just never got anything.
I am also not sure of line 13 Current immigration status. I overstayed
B1/B2 visa but applies for AOS based on marriage to USC.

I don't believe you should fill that form, did you ever photocopy
the one you sent to them ? I think that's enough...

I'm not sure if you need to fill out another I-765 (I seem to remember
that you indeed do). But why don't you just go ahead and fill it out? It's
gonna cost you a penny in ink.

For question 11, say "Yes, I applied more than 90 days ago at XXX office.
Application is still pending."

For current immigration status, say "AOS pending"

It is 90 calendar days (if the 90th day falls on a weekend/holiday, BCIS =

gets until the next working day though). The regulatory citation is 8=20
C.F.R. =A7 274a.13(d).
